Hi Everyone,

 

Have a friend with a car loan from Moneybarn.

 

In the past 6 months the company he works for has struggled and he is 4 months behind on his wages (he's supporting the company through this as he sees light at the end of it).

 

he has a car loan with Moneybarn, which recently he became 3 months behind on payments.

 

He received a default notice a few weeks ago demanding £1200 blah blah blah.

 

Yesterday he received a default from them.

 

In-between the notice and the default he managed to pay 1 months payment but has still received the default.

 

Can they do this as he isn't 3 months behind or did he have to remedy the total amount on the default?

 

Also, for the past few years he has been charged an extra £18 for making his payments through their on-line portal and not by DD.

 

Plus extortionate late payment fees.

 

The default sum also reflects the charges.

 

before anyone asks, I have asked him to find out how much he has paid, length of contract etc , he will get back to me with this info

They can place a default for only 1 missed payment if its not rectified after issuance of a default notice within the date stated.(normally 14 days)

And if the default notice is not for the correct amount? Or includes ,multiple charges of £18 for paying through an online gateway?

The amount is irrelevant...a default is a default...payments were missed.....if it was a court claim that would be an entirely different matter

In terms of repossession though, is he looking at a minimum of 3 months arrears before they can reposes?

get him to go do a time order

that's the only way with moneybarn he'll get to keep the car

if he wants to keep it

 

they've issued a default notice

so can quite legally send a repo guy and snatch it for the public highway at any time.

 

if its on private land

or all the better

locked behind gates or in a garage

the repo guy has no powers whatsoever to repo or demand the car from those places

they are NOT BAILIFFS.

 

has he paid more than 1/3rd please?
