Aplogies as an absolute newbie here, however I was asked to create a new thread.

There is another recent thread (I can't post links, maybe someone else could as seems daft to recreate a whole heap of stuff). I am in the identical situation at the same location

I have just received an identical letter from UKCPS, all details completely as the above mentioned thread (same paperwork).

My wife was driving my car that day, obviously she didn't spot any signage etc.

28 minutes over a 4hr limit.....

Disgusted that companies can request such 'fees', she is disabled (was parked in disabled bay, with badge on show) which has left me even more disgraced at these cowboys operate, with no extra time for disabled people....

Question is approach them & ask for 'understanding'?

Dismiss? etc etc

Hi All

I got an NTK through the door from UKCPS yesterday.

No ticket on the windscreen,

I am assuming it was an ANPR generated ticket.

It appears to be UKCPS standard NTK for a stay beyond stipulated time limit.

Details below:

For PNC's received through the post [ANPR camera capture]

please answer the following questions.

1 Date of the infringement Allegedly 17 November 17

2 Date on the NTK [this must have been received within 14 days from the 'offence' date]24 November 17

3 Date received 27 Nov 17

4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] No

5 Is there any photographic evidence of the event? None provided or mentioned, but I'm assuming they must have entry/exit pictures from ANPR?

6 Have you appealed? {y/n?] post up you appeal] No

Have you had a response? [Y/N?] post it up

7 Who is the parking company? UKCPS

8. Where exactly [carpark name and town] Bristol Abbeywood BR005XX

For either option, does it say which appeals body they operate under. IAS is mentioned on the back of the letter.

There are two official bodies, the BPA and the IAS. If you are unsure,

please check HERE

If you have received any other correspondence, please mention it here Nil

Thanks for that. Now, as this bunch of clowns belong to the IPC which are a very flawed members club, you will have no chance with their appeals service nor with the IAS, the supposedly independant appeals service.

For info, the IPC and the IAS are one and the same and the solicitor of choice are Gladstones who, surprisingly have their fingers in the IPC and the IAS.

If this company had been a member of the BPA, the code of practice is to not ticket any car that is disabled and badge shown however this is ANPR so with them, you send proof of disablement and the ticket should be cancelled. Unfortunately, you are stuck with the IAS.

I would suggest that you ignore all but court papers as that is the only way you stand a chance of fairness.

Thanks for your response....

I feel there are many aspects that could be argued here, let alone the legalities.

Requesting a fee for a disabled person taking to long being quite an ethical one! Let alone being "forced" to wait an extremely long time for service at the onsite restaurant.

I think I know what thread your on about.

The lady only won the case because of signage being wrong.

She was spouting off on equalitys act and human rights act and disability rules..

Non will work. Dont go there.

Just use the fact that its incorrect signage

an overstay is an overstay so playing the disabled blue card wont win you anything and doesnt make your case identical to others as you have already said it is about an overstay.

If you can find a thread about the same site then refer us to it and we can look at their images if they have posted them up.

  • 3 months later...

as it was posted at around the same time as mine.

Pictures of the signage are in the attachments in post 5.

ah250:

I have been posting scans of the letter chain I have received.

Assuming you have ignored everything so far, I assume that your letter chain is the same as mine?
