My husband had a letter from our local county court requesting him to complete an income/expenditure form.

 

The client was Arrow.

Due to a lot of financial stress in 2014 and loosing our home I had forgotten about the debt but noticed last year a CCJ for Arrow.

It relates to an old MBNA credit card.

 

I phoned Arrow who told me to ring Restons.

My husband gave permission for me to deal with it.

 

I responded by asking for a copy of the CCA so awaiting their response.

 

I also called the court and they asked if my husband was employed.

I advised no so she advised fill out the form stating unemployed and as the forms were a attachment of earnings form she says as he’s unemployed they can’t take it any further.

 

Is there anything else I need to do.

did you ever write to the original creditor or tell them of that address?

No. The debt hasn’t been with the original creditor for a long time.

 

I think it’s been with Arrow since 2008 and we had been paying pay plan for a few years

but in 2014 when everything got to much due to my husbands ill health and loosing his job we stopped paying non priority debts and allowed our home to be repossessed so we could save a deposit and rent.

so up until the repo that house was the last address PP knew so the last address your creditors had been updated with?

so the repo address is the one the CCJ was filed against?

 

did you not update PP anymore after you moved?

With Payplan we’d been paying but apparently while someone was doing a review on our account they done some error with it so the money I’d been paying was never sent to my creditors. They apologised but due to being a bad time in our lives I closed my account with them.

 

We moved house a few months later

 

I’ll ring Northants bulk and ask for a copy of the CCJ although I’m not sure how this will help us

I think given that your renting and your husband is currently unemployed...and that the CCJ was awarded in 2014...as the court has already advised there is little else Arrow can do with the judgment.

 

They have a further 2 years to try to execute...given your circumstances I see little success.

 

I personally would return the AoE as advised stating unemployed and return it...that should be the end of the matter.

 

Setting a side the judgment seems inappropriate given your circumstances...as for varying the judgment to monthly payment...thats an option for you to decide if you wish to start making payments....but as stated there is little else they can do or move forward with with regards the judgment.

what about a warrant of execution.

would a (this) creditor consider that option?

 

Never seen one from this claimant Ford...thats Cabots trick...we dont know the value of the judgment.

The CCJ was awarded in 2016. The debt is for just over £13,000.

 

I’ve returned the AoE but as the lady said my husband is unemployed due to poor health, my house is rented and the car is on mobility so there is nothing further the court can do.

 

I’m awaiting a response about obtaining the CCA.

So over 5 years to run before it falls off your CRAs..with you posting 2014 in your initial post I assumed that was the date of judgment.

 

Application to set a side (N244) is £255...(if you have grounds to set a side)....application to vary the judgment (N245) to monthly affordable payment £50

No he just said they’d post it out to me. Didn’t offer any alternatives.

 

Restons have responded and said as a CCJ has been registered then they are under no obligation to provide a copy of the CCA. Is this correct?
