This is a question about debt collectors court claim forms...

i would like to know what happens if i am issued with a claim form and i am away from home for an extended period?

What is the reason for the extended stay away from home?

 

You will be expected to make every reasonable effort to attend.

 

However, taking your question in isolation - if you’re away from home and a claim form is issued, you won’t know. You won’t be able to submit a defence and summary judgement may well be awarded against you, resulting in a CCJ.

aaah, but that seems very unfair.. i will be in south america trying to arrange a fiance visa... i am getting pestered by something called pra group..if they issue it when i'm away i'm sunk.. for the first time

Why is it unfair? You are aware of an issue. The claimant doesn’t just go from’you owe me money’ to ‘see you in court’ overnight.

Why mocked?

You used a term with a very specific legal meaning - it is relevant to the thread if you are meaning it in a general way or its specific way.

 

I must admit though : come out with discredited FMOTL mumbo-jumbo and there is a high probability that will be subjected to mockery .....

 

On a practical note : will you have e-mail access while you are away?. If so, 2 options spring to mind:

a) create an e-mail address specifically to give to PRA : if they agree to use it- sorted.

b) get someone to accept post for you / give that address to PRA. Get the recipient to open (and scan / e-mail you) anything that looks like it is from PRA / a Court claim form.

Need to know who thinks you owe them money, who actually does have the debt and who is demanding payment, then we can move up a gear with appropriate advice.
