Hi

My husband has an old tax bill,

he has paid around £1000 back but still owes £1500

I have been acting on his behalf and have had payment plans in place

however a few have failed and now they will not accept a payment plan.

 

They said a letter is in the post,

i think enforcement was mentioned.

 

We have no money in the bank ,

no savings,

live in a small rented bungalow and our biggest asset is a van my husband owes money to my mum or, he uses it for his business.

 

We are both self employed

i have made a loss this month

he is averaging only around £500/month at the moment.

We have a 1 year old baby.

 

Please, anyone been in the same position, what will they do next?

Going by what i have read, The letter will just demand payment and list enforcement options. The debt may end up with a debt collection agency, who will arrange a payment arrangement. HMRC just don't want to do the admin.

 

Come back once you have the letter.

 

Unless they have a court order, they won't send anyone out with enforcement powers, if that is what you are fearing. Different matter if your hubby has been taken to court already.

It is worth asking for information e.g Data Protection subject access request ( No fee required to HMRC) and ask for a breakdown calculation. The amount being requested might be wrong ?

 

If you search threads on this site, debts get chased by a DCA but not much seems to happen. Would be up to HMRC to take any enforcement actions.

We could do with some help from you.

Not really. HMRC don't want to employ Civil Servants handling payments over a long period, as that costs money e.g staff salaries, pensions, office space. Far cheaper to get a DCA to handle payments.

 

If the debt is correct and you want to pay, come to an arrangement with the DCA that is affordable.

Get the free sar done on the hmrc website

 

Ignore the DCA totally

They are not bailiffs

And are totally powerless

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

The SAR form on their website seems to be relating to national insurance, this is for tax, am i missing something somewhere?

 

Sorry, i think i have found it thank you!

 

Have written back to HMRC today so will await their repsonse and hope we dont get any 'visits' in the meantime!

doesn't matter what visits you get

a DCA is NOT A BAILIFF

and has

NO SUCH LEGAL POWERS

 

if they do call [very remote chance]

 

simply tell them to leave your property or you'll call the police 101.

i wrote to them again and have called them today,

they have the letter but it can take 8 weeks to process!!

 

they still refuse to set up a payment plan and a field officer will visit and i will have to discuss things with them....

 

.so if hmrc direct wont accept £40 per month,

are these officers going to accept less?

It seems to make no sense really.

 

What do these field officers actually do?

make sure they are from HMRC ask to see their ID

if it says advantis or Past due credit or whatever

they are a DCA and can be told to do one.
