Think this might be a quick issue to resolve but I would like your thoughts please.

 

Is it possible to apply for Data Subject Access Request for information on a deceased person? I am the spouse of the deceased and there was a Power of Attorney in place prior to death so I was next of kin.

 

I suspect that DSAR is only for living person but if that is the case how can I get access to information which involves me but was on his records?

no SAR is not limited to the living if you have legal right to it

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Have completed the one online and have drafted covering letter so hopefully that will suffice.

As the matter involved both my late husband and I, they will be in a position to provide both as the POA was recorded on their records.

Can I access information about the deceased under the Data Protection Act?

 

The Act only applies to personal information about a living individual. You may access information about deceased individuals through other legislation, such as the Access to Health Records Act.

I am aware of DPA and that POA ceases after death. The reasons I will be using this information to DWP is so that they are aware that I am not a complete stranger asking for information, and that whilst the main information I require is about myself, they do not have to be overly concerned about data regarding someone else. If they choose to with hold the data, that's not a huge problem as I have my own records in archive. Would just take longer to sift through.

I proved who I was was exec on both

Got everything

Even stuff from during WWII

whilst the main information I require is about myself, they do not have to be overly concerned about data regarding someone else.
they wld have to be overly concerned about someone elses data, as otherwise wld be a breach of statute. whether it be the dpa or access to records act etc. they have to follow the rules.

you asked 'Is it possible to apply for Data Subject access requestlink3.gif for information on a deceased person', and mentioned PofA re.

anyway, as you say, do the dpa re yourself and see what comes back. take it from there.

mind, if they take 40 days, maybe you cld've found it in your archive records by then :)

yes, that wld prob have been under the access to health records act which provides for disclosure to a proven exec/pers rep etc.
