Housing DHP - refusing previous amounts as now has PIP

Dear all

 

My elderly neighbour (63) has been receiving DHP to stay in her life long family home - her family have grown up and left, although one of her sons was murdered so the house holds memories. The lady has quite severe mental health issues and needs people to stay regularly.

 

The council has previously discounted one room and waived one on the basis of needing someone to stay. They now are only discounting one room, and stating in a reply that as the lady now receives PIP she should use this income towards her rent ?

 

Now I may be wrong but I believed Pip was to be disregarded in its entirety?

Whilst it is disregarded for calculation of HB, it does not need to be for DHP purposes.

 

Also as PIP is to pay for extra things a disability would bring, they are in theory correct in stating that PIP could be used towards her rent.

 

DHP is not a benefit.
