Slipped and broke my ankle!

I am just making an inquiry here.

 

I slipped on a pavement which was wet as it was drizzling and broke my ankle. I did not have on high heels with smooth soles and the street I was walking on was not slippery until I reached the McDonald's on that street and I slipped right outside.

 

Friends keep telling me I should sue but sue who..yes the ground was slippery which I found strange but I don't have a clue what to do about it. Don't want to go through any unnecessary processes...any suggestions? ?

You first need to identify it the area was private property (& to whom it belongs), or public pavement.

 

That will then identify who you MIGHT sue. You then have to ask “what duty of care do they owe, and have they breached it?”.

 

So, if they knew the surface was dangerous when wet, and did nothing about it : you might have a case.

If they had records showing they’d inspected the pavement at a reasonable interval, and on last inspection there was no cause for concern : you wouldn’t be able to show they breached their duty of care (unless they’d ignored reports of it being dangerous in the interim)

You could sue God (if you're a believer) as He created the rain, or Mother Nature if you're an Atheist.

Hang on! You are assuming that the owner of the land wasn't at fault, for it to be a "nonsense" "culture of claim".

 

I agree, it may well be that the OP has no claim, and it is just 'bad luck'.

However, if it wasn't 'bad luck', but an avoidable incident caused by negligence, the OP could have suffered losses as a result of negligence ... what if it were you?.

 

What if you had to take time off work and didn't get sick pay?.

 

Damages for pain / suffering aren't massive (and "other peoples' pain is very easy to bear"!) but why shouldn't the OP claim if there is a case?.

 

They are entitled to ask!....

and IF, on providing the details they don't have a claim,

THEN you are entitled to chide them for their "nonsense claim culure".

Given the usename shortwoman68, as her eyes are closer to her feet than someone taller, she should watch where she is walking.

 

Not much to add to BazzaS. If anyone wants to pursue a personal injury claim, it is up to them to gather evidence e.g take pictures from different angles of the issue that might have caused the accident, find out who owns the land and then pursue. There are plenty of Solicitors around that offer no win no fee arrangements. And don't just look at the ones that advertise nationally. Many local Solicitors can also help.

So what street and where? Find out if it is “Council” owned pavement.

I find your comment quite offensive.

 

For your information I was looking where I was going as there were not many pedestrians walking along that stretch of pavement.

 

The pavement was fine until I walked near McDonald's and it felt slippery.

 

However I will look into it as I missed out on 3 interviews because of the injury and ended up with 6 screws and a metal plate!

Have you spoken with the local authority about how often it is cleaned, who is responsible for it to be cleaned, and who you can complain too?
