      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi I tried to claim PPI from a Tesco credit card in 2012 I was rejected and didn’t take it to a ombudsman..

 

Defaulted 2009 and was paying £50 a month for a no of years. Then I dropped it to £1 per month in 2016. As I came out of work. Owe around £4000. But never upped the £1 pcm.

 

Had a CCA off them in 2016 but they’ve never chased for extra money only have a odd random text saying call as my arrangement has expired.

 

Fast foward to Sept 2017 I re applied for PPI under Plevin and have been offered some money however they want to take it off the debt.

Are they allowed to do this?

 

The acceptance forms says

By signing this form I confirm that this offer is rightfully mine.

 

I am aware this payment will be credited against any outstanding arrears on my credit card account within 28 days of

receipt off this acceptance form.

 

By accepting this refund. I confirm that any unfair relationship created between me and Tesco bank as a result of

undisclosed high commission or otherwise has been rectified and that this refund is made in full and final settlement

of any claim and complaint made by me against Tesco bank arising out of or in a connection with the sale of PPI

How much will it reduce the balance by?

 

Your credit file should be clear of this now, when did you take it out?

ANd are you happy that the CCA they sent is enforceable?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I don’t know if it’s enforcable. It will be £1600 off the balance.

 

However I was self employed and on the original rejected Ppi claim they said it would still ha e paid me on unemployment.

 

After I had SAR last yearI did go to FOS last year but it was too late. There is no way it would have paid me out.

 

I don’t mind the debt being reduced but that money would have come in handy. Is there anyway around this even half to debt and half to me.

 

This debt was never on my credit file after I went into a DMP in 2009

Just had a letter concerning this debt off a company called intrum seems likes they bought this back in Oct. and are now chasing payment.

 

I have been paying Tesco £1 per month for around 3 years. Before this I was paying 50.

 

The debt is now around £1500

 

Do I send CCA to intrum and stop payments with standing order to Tesco.

 

Ive just noticed intrum have done a search on my credit file too

Have you actually received a Notice of Assignment from Tesco/Intrum...is that the letter you refer to ?

I had a letter from intrum with another letter in from Tesco. Nothing from Tesco themselves. Shall I upload it

 

Here’s letter

 

Just checked credit report Tesco agreement came off in Feb 2016.

 

Although I wasn’t paying in full this was never defaulted by Tesco.

Account opened in 2003.

Not heard back from intrum in response to CCA request. But have received 2 further letters chasing debt.

 

Checked with Royal Mail. It’s saying we’ve got it but no signature from other party letter was sent on 8th Feb.

The only problem is on Royal Mail track and trace doesn’t seem if they’ve received my letter.
