Xercise4Less / Harlands - Admin Fee for cancelled DD **resolved**

Hi there,

 

First time posting, but in doing a bit of research before I delved into discussing a letter I received from Harlands, there seemed to be a lot of valuable information on this forum, so hoping someone can help with my specific situation.

 

On 31st March I took out a gym membership with Xercise4Less on a monthly rolling contract with the following information in an email confirmation from that date:

 

"You are committing to a single £20.00 admin fee payment and £19.99 per month for a minimum of 1 months. After this minimum term your membership payments will continue on a monthly basis.

You have chosen to pay by monthly Direct Debit and we can confirm that the Direct Debit details provided by you are correct."

 

"You have the right to cancel your Direct Debit Instruction at any time simply by writing to your Bank or Building Society, with a copy to us. Please note cancelling your Direct Debit does not absolve you of your Membership contractual obligations."

 

The following dates had direct debits of £19.99 taken out:

 

02.05.2017

30.05.2017

30.06.2017

31.07.2017

30.08.2017

 

I since have been taking on more responsibilities within work that mean I am not getting to go to the gym at all, and as such have cancelled my Direct Debit a couple of weeks ago, and thus my membership (or so I thought, as had been the way at previous gyms...)

 

However, yesterday I came home to the following letter:

 

"Dear XXXXX,

 

re: Your membership to Xercise4Less

 

Harlands administer the collection of all payments due under your membership agreement with Xercise 4 Less. Your bank have advised us that your September instalment has been returned unpaid "instruction cancelled".

 

You have therefore been charged a £25.00 administration fee which means you need to pay £44.99 to bring your account up to date. Call HARLANDS HELPLINE - XXXXXXXX immediately so we can collect this by DEBIT / CREDIT card and reinstate your Direct Debit over the telephone. If you wish to pay by another method, you must still phone to discuss your options.

 

If you do not call us by 23 October 17 you will be charged a further £25.00 administration fee. Our telephone lines are open 8:00am to 8:00pm Monday to Friday & 09:00am - 12:00pm on a Saturday.

 

Your sincerely,

 

Harlands"

 

 

My question then is how to handle this? I do not want to reinstate my DD / gym membership. I do not think they are legally allowed to charge me an 'admin fee' (?!), I do not want them to continue adding more lots of £25 to my 'account', and I'm not sure whether ringing them would be a good idea at all.

 

Any help would be much appreciated!!

Dont worry about it. Its an unenforceable penalty. they cant do anything at all to make you pay it.

 

Your issue is no different to hundreds of others on here. Have a good read and do what they did.


Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

I was thinking of using the following template that has been suggested before, as the case seems similar to mine:

 

"I refer to my membership at Xercise 4 Less gym in XXXXXXXXX which was a month to month agreement.

 

I cancelled my direct debit mandate in September but realise now that I should have given 30 days’ notice to cancel. Cancellation of the DD mandate was adequate notice of my wish to cancel.

 

So I now offer to pay £19.99 for the notice period.

 

I will not pay you any administration or cancellation fees.

 

If you confirm in writing that you will accept the amount of £19.99 in full settlement of all that I owe, I will pay you promptly. If you fail to accept my offer within 14 days or you demand any higher amount, I will pay you nothing and my offer will be withdrawn.

 

 

 

 

 

Yours Faithfully,

 

XXXX"

 

Think that looks OK?! Not sure where to send it to though as there was no return address on the letter from Harlands. Head Office google search maybe?

Letter is good to go IMHO, ensure you get ''proof of posting'' which is free from the PO counter.

 

Send it to their H/O.

 

Then get onto social media and embarrass the gym, inform current and any future customers that this is how they will be treated.

 

Ignore any further letters from this powerless outfit, just hammer the gyms complaints procedure.

Awesome, well done, you will continue to receive empty threat letters, and even one off their tame solicitors spouting all sorts of nonsense, however, you can rest safely in the knowledge that there is NOTHING they can do.

Phew! I'm the sort of person who gets insanely worried about this kind of thing, so that's reassuring to hear! It's a horrible tactic, and I've never had this sort of issue with cancelling MY direct debit before?!

Exactly what these outfits rely on, customers not knowing their rights when it comes to money and agreements/contracts.

Yes they DO go away, however, that does not mean that the gym can get away with the treatment of its customers, so they must be made accountable for their actions and embarrassed on social media, highlight the treatment too them and any future customers.

Hi Newo and welcome to CAG

 

Don't worry about Harlands/CRS and their tactics. They'll do and say anything to scare you into paying them the admin fees they want. But their threats are nothing more than HOT AIR !!

 

The letter you've sent is all you need do for now.

 

Oh, and don't even THINK about calling Harlands/CRS for any reason. This would get you nowhere and there's no need for you to hear any rubbish they want you to believe.

 

Keep us posted when they reply but don't waste another second worrying about Harlands/CRS - they are powerless chancers !

MASSIVE SUCESS!!!

 

I ended up getting really annoyed by the whole tone of the letter from Harlands and the impending pain having to deal with them / generally get harassed,

 

 

along with my letter to Harlands (thanks so much for the advice!),

I also send a bit of a stroppy email to the whole world and his dog that I thought may be involved (General info addresses, CEOs, sales etc.),

from a random email address I no longer use (so didn't care if anyone had a hold of it), with no personal information.

 

I had a number of responses from Harlands,

the Xercise4Less branch concerned,

and the building unit the gym is located in

- before receiving the following back from the gym,

having concerned my membership number directly:

 

"Good afternoon XXXXX,*

 

Thank you for your email.*

 

I have now removed all administration charges and cancelled your membership down with no further payments, it can take Harlands up to 5 working days to receive and action our requests, please ignore any correspondence regarding arrears you may receive within this time frame.*

 

Please take this email as confirmation for the cancellation of your membership.

 

Kind regards,**

 

XXXXX"

Excellent news and well done.

 

Maybe finally X4Less are starting to realise Harlands are terrible at handling their members DD's and m/ship issues.
