Hi All.

My wife had a membership with Xercise4less for over 12 months and decided to cancel the membership.

She cancelled the Direct Debit, thinking that was all she needed to do.

She then received an email from Harlands advising that she had not responded to a letter that was sent out, the copy of the letter in the email had the wrong house number bot correct street name.

She was locked out of herXercise4less account so she couldn't give 30 days notice via the website.

She has since called Harlands and paid £34.99 (£9.99 membership and £25 Admin Fee)

They have advised that they will reactivate the Direct Debit and that my wife can now give 30 days notice via the website.

She has now cancelled the membership via the website.

I have just found the forum after she made a payment to Harlands.

My question is,

why should she have to pay for another months membership after she cancelled the DD and made the payment when she couldn't access the account to cancel the account when access was restricted.

Is it safe to cancel the new Direct Debit and ignore all correspondence from Harlands

Thanks in advance for any help or comments.

Tom

STOP!!!

If she paid over the phone using her credit or bank card, then you MUST reclaim the unlawful penalty fee of £25 using the 'visa debit' chargeback.

STOP ringing these clowns, the penalty fee of £25 is unenforceable.

CANCEL the DD immediately AND inform the bank that if there is a continuous payment authority on the card, then it must be cancelled and no further payments are to be made to them without her express permission.

Complain to the gym manager, when they fail to do anything, then escalate it to their head office, embarrass the gym on social media too, let everyone know that they employ a powerless clown outfit who add arbitrary charges and fees.

Completely ignore the utter drivel Harlands spouted, they will tell you the moon is made of cheese and have you pay them for that little gem of info.

ALL she has to pay is ONE months fee (£9.99?) and cancel the DD.

As Harlands have already been paid this fee, £9.99, then there is NOTHING further for your OH to do.

Keep a record of accounts and diary of events, but PLEASE ensure you get the unlawful penalty fee of £25 back using the visa debit chargeback.

They, 'Harlands' will attempt to con you out of more funds, BUT they are completely powerless to do anything, they CANNOT take your OH to court, they CANNOT mess up her credit file or add default markers, and they CANNOT demand charges.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi Tumshi and welcome to CAG

If you paid the monthly fee and the admin fee in one go, you need to reclaim the whole payment using CHARGEBACK. You can't reclaim a part of it.

Do this via the bank immediately telling them you were deliberately misled by the payee to pay more than you owed. The bank should action the refund without argument.

Once they refund to you, let us know and then we wait for Harlands to come back to you balling their eyes out !!
