    • Hi Rei and thanks for the update.   Your post confirms what we're telling folk all the time - Harlands/CRS, Zinc and their pet "solicitors" continue to make demands but they fail to do anything substantial to back up their threats.   Hence our continuing advice to NOT respond to demands by letter, email or phone, because they'll do nothing that will affect your credit rating, or that will force you to pay.  
    • Hi GHL and welcome to CAG   You now have your own thread to use from here on ( to avoid hijacking someone else's thread where you first posted).   I assume there were 2 separate m/ships and not a joint m/ship, but please confirm.   I hope you've read other threads here which should help you understand how Harlands/CRS operate. They use every opportunity to make far more money from missed payments and penalty fees, than what they make from taking a percentage fee from ongoing monthly gym fees.   Yours was a rolling monthly m/ship so you only needed to give them notice to quit but there was no minimum 12 month term. Hence all you owe them is £19.99 each.   Write a letter to Harlands, each of you :- 1. Offering to pay the £19.99 for the notice period you failed to give 2. Offer valid for 14 days only. 3. Offer withdrawn if they fail to accept, or if they demand any higher amount.   Post a draft of your letter here first so we can check it.    Letter(s) should be sent from the PO and get a free Certificate of Posting from the PO Counter.  
    • King I fully understand the mother was living there on her own and only one named on the tenancy agreement.   As for your comment that after informed of the passing in a few days they pack tenants belongings and store them and change the locks this I completely disagree with.   In my are the different HA (and there are many) in a scenario like this will:   Communicate with the executor/family member once informed of bereavement informing them of any succession rights, property to be handed back ( 28 days on being informed of above) if unable to must notify the HA to ask for an extension.   After the 28 days if no contact the HA will then follow its Abandonment Policy.   If contact made after 28 days and no extension has been granted HA will then go to court to claim property back.   Once this is done and no contact off to court to claim property back only then will the enter the property unless in an emergency or legally required i.e. gas safety inspection even then may need to go to court for that to get access.

I only spoke to them on phone as had no letters other than eviction one..

was told by who is case managing my file that it could only be done on the phone

 

 

said if I did they would work with me and do a pay payment plan

to which they after 2 hrs at one point and an awful draining emotional call said no

they could not stop eviction only reduce the amount I have to pay which I feel is too much still ..

 

 

it’s settinb me up to fail come next month

I mean a main highstreet lender wouldn't blindly threaten to eviction someone without them telling you who they were......

I have Halifax address it’s the case managers address which is secured collections that I don’t know if I have

If you had emails from them, I would expect a large company to have their address details after the message they send you.

All the departments will be located at the same address - you just write on the envelope which department it is for - i.e. "For the attention of Secured Collections Dept" then Halifax and their address.

 

I really do think you should write to them before entering an N244 we can tell them that you will be advising the judge of their behaviour

 

- they might just take notice and cancel the eviction.

Yes if you could . I called the case manager dept they are based in Chester under evictions department , I asked them to give me their address and asked if they would reconsider my proposal they said no because they had already reduced it to £2100 so I said I’ll write .

I wanted their address so it didn’t spend days going round departments and made it to the correct dept for them to sign to say they recieved it . I do understand the point of not calling them

Hi, you did the correct thing in getting the address for the relevant department, it saves any delays in the letter getting to the right person.

 

 

Affixed is a draft letter for you to look at. You need to put Halifax address in and the mortgage account no. Also within the letter there are XXX's where the amount you are offering needs to go. Remember to keep a copy for yourself and also keep the postal receipt safe so you can check they have received it and print off the signature.

Just had a letter through dated 19th sept from a different Halifax address .

Enclosing the income expenditure I did over the phone and saying that some figures may be estimated and if I could go through it and get in touch if I need to make any changes.

 

It then says

“ we use the information to assess your affordability and agree a manageable way to repay your arrears.

Even if you’re only able to make small monthly repayments, this is first step to getting finances back on track”

 

I know this must be a generic letter but it’s insinuating I can agree a payment plan????

 

I do need to amend some of the figures on there

OK, amend the figures on the sheet and make sure you leave yourself plenty of money to live on. I have affixed our budget sheet which calculates automatically as you fill it in, it might be helpful to get you to the right figures.

 

 

Take a copy of the letter you have received and your amended budget sheet - circle in red pen the part which says "if you can only offer a small amount etc) and affix these copies to the letter you are sending - just to point out to them that one lot doesn't know what the other lot are doing !!!!
