    • Thanks, @FTMDave for your feedback, I will take your points on board. I was using the title "Mitigation" in an attempt to convey how reasonably I have behaved, and how stubborn and overzealous (i.e. unreasonable) the claimant and their solicitors are. Any suggestions for a more appropriate title ? Cheers --skeet23
    • Hi guys   4 old debts (catalogues) have been sold to Lowells, I requested copies of credit agreements and received them this week.  I also received a notice of assignment from them for an old Vanquis account.  I need to pay these debts off but don't want them touching my bank account so was thinking of setting up a standing order.  I guess I will have to send them details of income and expenditure.  My question is, do I need to give my husband's details?  We are not really getting on at the minute and this will be the last straw for him so I would rather just leave him out of this.   Many thanks for reading x
    • I am unable to get credit of any description, apart from a payday loan with expensive Provident.   I have 3 accounts, 2 with Capital One, the other with Vanquish.   These 3 do show late repayments, but Capital One is showing partically settled in September 2018 and Vanquis settled in full in December 2016.   The main issue I had is with NewDay Ltd.   I notified NewDay that my disability living allowance was stopped after I had my review when I went to transfer over to PIP.   NewDay were sympathetic, and agreed to place my account on hold, freezing interest and payments etc etc.   On the 4th May 2018, I received a letter from NewDay; theyagreed that due to my financial issues, they would no longer chase me for payment.   Soon after, a default was issued with with credit reference agencies that the account default with a default date of 12th June 108.   Why then agree to not chase me for payment then issue me with a default seems to me to be grossly unfair!?   I did a Notice of Correction on my credit file to show lenders that my account was on hold, and they agreed not to chase me for payment.   Can anyone please give me some advice?   I have a good income of £1100 a month in benefits income, and I state on applications I am retired.   I am initially accepted for credit, but they then go to the CRA's, I am then declined.   Its frustrating I can only get a loan with Provident.
    • Sorry, I don't think I explain my case correctly. I'm the guarantor for a friend that rented a shop. My friend couldn't make rent repayment and the landlord terminated her contract. Now the landlord (claimants) has taken out the claim against me as I was the guarantor and is responsible for my friend's debt. When I first  became the guarantor, I signed an agreement with the claimants. ( 1st agreement) A year later I had a meeting with the landlord to discuss my debt situation and told them I was struggling to make repayment. They agreed to give me a debt deduction and other terms, so a new agreement was drawn up (agreement 2). to replace the 1st agreement.   In 2016 I received a warning letter for late repayment. No further warning letter or contact has been made by the claimant since 2016 so I was shocked when I received the money claim.  Claimants have only attached the 1st agreement with their claim form and they denied there was a 2nd agreement. Now they have submitted their final witness statement and attached the 1st and 2nd agreement. Proving the 2nd agreement does exist.   My question is; 1. How important is it that no letter before action was sent before I received the money claim? 2. Now there's proof of a 2nd agreement which was signed and dated after the 1st agreement. Does it prove that the 1st agreement is invalid? 3. Would the court dismiss this claim if they believe the claimants have submitted an invalid agreement for their money claim?    Thank you. 
    • Hi   What date did they move into the Property & when did the Tenancy end?   How long was the initial Tenancy Agreement for?   Did you pay a Deposit/Holding Deposit for the Property?   Exactly what Notice of Arrears was given and when(what date)? (if for rent arrears)   Are they still in the Property or have they ended their Tenancy as per the Notice requirement to end that tenancy?   Is the Claim for Rent Arrears/Damages etc.?   Have you sent a Subject Access Request (SAR) which is free(due to GDPR) to the Landlord/Letting Agent asking for 'ALL DATA'?

I rang halifax and checked the number they confirmed this is right

just writing my complaint now .. i hope they look into it and resolve things

 

I don't understand why they wouldn't me not do the income expenditure on my own and only accept it over phone ..

 

she inferred that they would accept my proposal if I did that as it would help me.

I said I was exhausted mentally but wouldn't let me off the phone and made out she had all the power and had already done me a favour bug lowering the amount of payment they wanted to stop the eviction

yea some foreign operator on commission to get results I bet.

in your letter

tell them you want a copy of the recording that they took of that call

and all the others that have distressed you.

 

 

as you wish to raise a complaint with the FOS/ICO/FCA and your MP/

She wasn't foreign she was my case manager but was on a power trip , she said she wanted to know what I was complaining about her about I said I just needed to get off the phone and she kept on and on ..

do the complaints dept ever resolve things and change the outcome or agree to my proposal at all?

I have a secured loan with another provide they have a bad reputation and even they have never acted this way to me

 

How on earth do I get them to accept my proposal

 

The complaints team called and said it was serious at this point so talks and phone calls had to be done in this way as I was at the point of losing the house.

 

They asked me if I was going to pay the £2100

I said I hadn't decided yet if I would do that as I was most likely going to put in an N244

she asked why again ???

 

I am unsure what to do from here.

 

My proposal is £1000 upfront and the Future payments of the cmp as I was told they would capitalise the rest of the arrears

so what do i do from here... i cannot afford £2100 i want to pay .. i cam afford to do that but i want to pay every month going forward .

 

No idea where to go now .. i don't really want to do an N244 .

 

Should i write to halifax again???

to whom?

they were quite annoyed i wrote to the managing director of lloyds banking and mentioned it several times oooops!!

They aren’t looking into the complaint further as they said they have done every they should..

. what do I do from here

 

That should read they said they have done all they should as it’s a very grave Time for me so they should of course discuss the account and my finances and my health at such great detail.

 

I want them to accept my proposal without me going to court..

is it likely if they are threatened with me getting the phone recordings

I would be writing a letter of complaint to the MD on the way you appears to be being treated

state also that you refuse to now communicate over the phone following the harassment and abuse you have suffered

not by email.

Yes had it in writing .

I wrote ( emailed ) to someone called Antonio who is the head of Lloyd’s/ Halifax they didn’t seem pleased

Made the mistake of putting the post on money saving expert to be told Halifax are right and my mental health has no bearing on whether I can pay my mortgage or not etc!

 

 

I feel like saying it’s not cut and dried !

If life was perfect I would have been paying

 

Also if I have a complaint with ombudsman does the eviction get delayed till it is resolved ?????

Can you give some more background please. What type of housing - Council? Housing Association? Private? Do you own or rent? What's happened so far? Which Ombudsman?

Apologies ... I have had eviction date set for 2nd Oct for arrears with mortgage . Brief explanation... I have 9k arrears and spent 2 hrs at one point on phone to Halifax ... they wouldn’t let me do income expenditure over phone, they made me send every bank statement for last 4 months and interrogated me on every spend .. they told me I’d have a payment plan if I didn’t it this way the. Said no and I’d have to pay £2100 .. I said I can pay £1000 as £2100 would mean I couldn’t meet the next payment and I really want to get on track with it . I complained and was called back next day by Halifax who said because my situation was grave I was spoken to in the appropriate way and she would put that in writing and send it out. I said I will complain further for the harassment.

Hi there, I'm afraid I think that an N244 will be what you need to do. We can help you with the statement for the form and advise the judge how you have been harassed and how it has affected your health. Once you have entered the N244 the court will send Halifax a copy and I bet they soon cancel the eviction when they read it !

I can help you draft a letter with your offer of £1,000 and an amount towards the arrears going forward and advising them you will be entering an N244 with full details of their behaviour for the judge to see.
