    • If it was done via N245 and the payments are up todate then the landlord must make an application with fee for a redetermination. Can't execute with bailiffs can't do anything until he attends a hearing and presents his arguments    ignore. Andy
    • Sorry I didn’t think to come and update this.    So the outcome was that he went to court. Apparently the judge told the landlord off for not sending a letter before action but did nothing about it. He didn’t accept all the damages the landlord claimed, and told him off for accusing my friend of deliberately and maliciously damaging anything, and he awarded him small amounts of the damages he claimed for. The landlord had also made an awful lot of things up that never existed and accused my friend of stealing them, and the judge didn’t accept any of those claims.   However, I’m back asking advice now. So he made an offer of payment via the court forms, sometime before Christmas and straight after the hearing. The landlord didn’t reply so the court accepted the payments.  My friend has been paying the £10 a month each month. Then a couple of days ago he had received a letter from court with a hearing date in a couple of weeks, and a very irate letter from the landlord saying that my friend has consistently lied and that nothing he says should be believed, and that he wants the bailiffs to be called on him and that he absolutely refuses the payment plan. The letter is marked as received by the courts in December and this is the first that’s been sent since then. My friend and his wife are now panicked, what does this mean? And can they now get bailiffs sent round? He earns an ok wage, which somehow the landlord has referred to in his letter, but he equally has a lot of expenditure and can’t afford to pay any more. What will happen at this hearing and can they send out the bailiffs just because the landlord wants them to?    I have no clue what to advise him, can you help at all please?
    • Thanks Bank – I took your cynicism / experience on board and responded thus: Thank you for your response Mr Schnur  I set out my position quite clearly in my letter of claim and nothing has changed. Your insurance requirement is unlawful and is contrary to section 57 of the Consumer Rights Act, and also section 72 of the same statute. I would also refer you to the outcomes in PENCHEV v P2G (225MC852) and SMIRNOVS v P2G (27MC729).  My deadline for action - 1 May 2024 - still stands.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I rang halifax and checked the number they confirmed this is right

just writing my complaint now .. i hope they look into it and resolve things

 

I don't understand why they wouldn't me not do the income expenditure on my own and only accept it over phone ..

 

she inferred that they would accept my proposal if I did that as it would help me.

I said I was exhausted mentally but wouldn't let me off the phone and made out she had all the power and had already done me a favour bug lowering the amount of payment they wanted to stop the eviction

in your letter

tell them you want a copy of the recording that they took of that call

and all the others that have distressed you.

She wasn't foreign she was my case manager but was on a power trip , she said she wanted to know what I was complaining about her about I said I just needed to get off the phone and she kept on and on ..

do the complaints dept ever resolve things and change the outcome or agree to my proposal at all?

I have a secured loan with another provide they have a bad reputation and even they have never acted this way to me

 

How on earth do I get them to accept my proposal

 

The complaints team called and said it was serious at this point so talks and phone calls had to be done in this way as I was at the point of losing the house.

 

They asked me if I was going to pay the £2100

I said I hadn't decided yet if I would do that as I was most likely going to put in an N244

she asked why again ???

 

I am unsure what to do from here.

 

My proposal is £1000 upfront and the Future payments of the cmp as I was told they would capitalise the rest of the arrears

so what do i do from here... i cannot afford £2100 i want to pay .. i cam afford to do that but i want to pay every month going forward .

 

No idea where to go now .. i don't really want to do an N244 .

 

Should i write to halifax again???

to whom?

they were quite annoyed i wrote to the managing director of lloyds banking and mentioned it several times oooops!!

They aren’t looking into the complaint further as they said they have done every they should..

That should read they said they have done all they should as it’s a very grave Time for me so they should of course discuss the account and my finances and my health at such great detail.

 

I want them to accept my proposal without me going to court..

is it likely if they are threatened with me getting the phone recordings

I would be writing a letter of complaint to the MD on the way you appears to be being treated

state also that you refuse to now communicate over the phone following the harassment and abuse you have suffered

not by email.

Made the mistake of putting the post on money saving expert to be told Halifax are right and my mental health has no bearing on whether I can pay my mortgage or not etc!

 

 

I feel like saying it’s not cut and dried !

If life was perfect I would have been paying

 

Also if I have a complaint with ombudsman does the eviction get delayed till it is resolved ?????

Apologies ... I have had eviction date set for 2nd Oct for arrears with mortgage . Brief explanation... I have 9k arrears and spent 2 hrs at one point on phone to Halifax ... they wouldn’t let me do income expenditure over phone, they made me send every bank statement for last 4 months and interrogated me on every spend .. they told me I’d have a payment plan if I didn’t it this way the. Said no and I’d have to pay £2100 .. I said I can pay £1000 as £2100 would mean I couldn’t meet the next payment and I really want to get on track with it . I complained and was called back next day by Halifax who said because my situation was grave I was spoken to in the appropriate way and she would put that in writing and send it out. I said I will complain further for the harassment.
