    • Wouldn't it be simpler not to bother with an Employment Tribunal?  Your wife leaves on 31 July and then you sue them in the small claims court for wages ( plus any filing fees ) from 01 August to the leaving date she originally wanted.   I see this as a simple money claim, not an employment issue.  They might not even defend it.
    • Hi all,   Looking for a bit of advice if possible.    Short overview: - Had a Vanquis debt for 2k from 2010 which up until 2016 i was paying amongst others via debt management company. I cancelled my debt management plan to tackle the debts myself which was effective all except Vanquis from whom i had no contact from until 2 months ago when the debt was sold to Lowell. I sent off a CCA request to Lowell and they sent me a Digital Signature Application which is the same format as the one i have posted below. They also sent a set of Terms and Conditions, which had not date on them APR rate etc. To get this matter cleared up i offered a settlement figure of £500 which of course they refused, and sent me a counter offer with a 20% discount. This is as far as i have got with them to date, i did not respond to counter offer and am awaiting their next move.   I had the default that Lowell put on  my credit file regarding the above account, removed by Experian. I wrote to Experian and said that Lowell could not prove the debt was mine and that was all i wrote. A  correction was put on my credit report and the default from Lowell removed, the correction has now dropped off along with the default. As far as i am aware Experian would of contacted Lowell with my dispute and Experian could only remove the default from my credit file with the lenders permission.   I quote from Experian website "If the lender realises their data was incorrect, your report will be updated to reflect this. Note that we can’t change or remove a default on your report without the lender’s permission. However, we’ll do everything we can to help you sort out a dispute."    My question really is, do i have any leverage with Lowell? I would like to settle the debt but do not want to have to pay these bottom feeders any more than i have too. Does the fact that the default being removed from my credit file mean they can not prove the debt  if i was  to take it as far as court? What i am hoping for is to get a low low settlement offer from them so i can clear the debt and move on.   Any help or advice, points of view would be greatly appreciated.
    • I don't understand why your insurers will only pay for part of the damage caused by the lorry.  Do they think some of this damage was pre-existing or just general maintenance or something?  I presume you've asked them why.   Also, why are you so keen to have a cash settlement and why are you so worried about whether BRS will pay the builder?  If they don't pay him, he can sue them.  It's got nothing to do with you.
    • I can't click the 'click me' link. I've managed to delete all personal info, but the file is 6.5mb as they put 7 letters into one file and I can't delete any pages. I moved house so will not have received most of the letters.  Just looking at the dates it looks like they may have confused the issue date and the date of the offence etc in the last three letters they sent, but it may just be wording. I will see if I can compress the file

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
      I’m so stressed,
      can u appeal this or should I just accept it?

Currys/pc world can I return for refund?

bought a computer for my daughter 4 days ago from currys/pc world.

It was described as a social computer which means just basic use.

I said thats fine she's only 11 so as long as she can play basic games and watch you tube that's ok.

The assistant said yes.


got it home and it was absolutely terrible.

I think it took 6+ hours for all the updates,

not sure exactly on the time but went to bed and left it on overnight.



The next day my daughter put it on it did even more updates for half an hour and on the left side of the screen a name popped up (something??) whatmann?

I just had a feeling it had been used before (was sealed when bought though).



she managed to just add a desktop pic and couldn't do anymore because it was that slow.

I decided to take it to my sisters house incase it was down to my Internet running slow, so tried again there.



We could barely open a page without it freezing, took about 15 mins trying to open 3 tabs and wouldn't close them straight away either also YouTube was buffering so no music either and the front speakers set at 100% played at about 20/30%.


Checked reviews later and they were all terrible,

I've looked online about taking it back and people have all put their experiences saying they won't refund as item open and used,

but if I didn't open and try how would we know.



I really don't want to be stuck with this as it won't be and can't be used, I genuinely think it's faulty.

Does anyone have any advice on my rights with returning it?

If it is faulty, you can return it.

If it was misdescribed (based on facts), you can return it.

Where it gets difficult is if it isn't faulty, and hasn't been misdesecribed / misrepresented, but becomes a matter of opinion as to what a 'basic', 'social' PC should do.


Probably the key issue is why it is slow.


In theory it meets the minimum spec to run Windows 10


although this only means it could run Windows 10, not will run it at any reasonable speed.....

Needling to do lots of updates : not a reason to return the PC, as any replacement will also need the Windows updates. You need to look at its speed / performance once all relevant updates are done.


Youtube buffering? You need to establish if it is the PC that is the issue, or youtube/the internet connection. Again, you can't reliably do this while performing updates....


This PC has a AMD E1-7010 Processor, which might be the cause of your woes, if you are placing too much demand on it.

It also only has 4Gb of RAM, which again may be the cause of the woes. If the RAM is fully utilised it may have to use a 'swapfile' in place of RAM, which will lead to data being written to the hard drive all the time. If this is this case you'd heard the hard drive working constantly.


Malware might be a problem too, so if all else fails scan it with malwarebytes.

There are many more possibilities, (including running 2 'competing' anti-virus programs that then conflict)


So, start Win-doze, and make a cup of tea, natter to your friends, and let it do everything it does until it has completed all its housekeeping.

Then open up "Task manager' (press the windows button, or click the windows icon in the bottom left of the screen).

Go to the "Windows System" part of the menu that appears, and Task manager should be clickable there to start it.


Open up one window of your browser, and try an play one video from youtube.

Task manager should give you an indication of CPU and memory usage on its default "processes" page, but next to the processes tab is a 'performance' tab that will let you look at CPU usage, memory usage and more.


Down the bottom of the 'performance' page there is a clickable link to "open resource monitor" : if need be you might be asked to look here for further details.


Post back with some indication of if there is something clearly making it slow, or some resource that seems 100% utilised much of the time.

under CRA you can return it for no reason at all within 14 days

within 30 days if faulty

and you should be given a full refund



I believe the store has a 28 days returns policy anyway

but watchout for their unlawful restocking fee!!

please don't hit Quote...just type we know what we said earlier..


if everyone stopped blindly paying DCA's tomorrow

the biggest financial industry in the UK, DCA;s would collapse overnight.

Under cra you cant just return goods in 14 days for no reason, that would in effect force a returns policy on all retailers.

The item was bought in store, not online.


That's not to Say you cant return it as not as described but you need to follow the advice in post 2

That wold only apply to online purchases, not in store purchases.

PC World does have a 28 days return policy, but only on unopened items.

I've never heard of PC World/Currys charging a restocking fee though.
