    • Okay please go through the disclosure very carefully. I suggest that you use the technique broadly in line with the advice we give on preparing your court bundle. You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

The defendant contracted Evri to deliver the parcel (Evri Reference xxxxx) and refuses to reimburse the claimant on the grounds that the claimant did not purchase their secondary insurance contract. The defendant seeks to exclude their liability in breach of section 57 Consumer Rights Act. The secondary insurance contract is in breach of section 72. The claimant seeks reimbursement of £265, plus P2G fees of £9.10, plus postage costs for two first class letters to P2G of £2.70, plus court fees, plus interest.     • In the SAR, I received the original application, lots of computer print outs, yearly statements from 2013 and the new emails regarding my complaint. They sent me a £50 cheque after I chased them for the SAR after the 30 days. They said they was waiting for me to respond to an email (which I never received) before sending the SAR

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

Just to let you know where we are up to on this one.

 

DPA letter sent 16th October.

 

I have today received the copy statements and will claim £1,057.60 from them.

 

As I have heard that Nationwide close accounts I will add a few words about them not closing this active account with a few threats that this will cause us to fall behind with Mortgage payments etc.

 

Can anyone suggest wording I can use?

They have declined our request for repayment.

 

They will now get the secondletter.

when you first wrote to nationwide did you ask for a list of charges or did you ask for statements for last 6 years? also what address did you write to?

any help would be great

After delays they were sent the letter before action 3rd Jan.

 

We received a letter 17th Jan declining to repay the charges with a very nice section in it as follow:

 

"We are genuinely sorry that this matter has caused you concern and hope this clarifies the situation and explains why we are unable to refund your charges. If you feel that you are unable to abide by the terms and conditions of your FlexAccount then regrettably it may be an appropriate time for you to consider changing your account to another provider."

 

Sounds like they are threatening me. Well I ask all of you who have accounts with Nationwide to follow my example and close them!!!!!!:o

Acknowledged MCOL today. We seems to be on the same time line. As I understand it sometimes they say they are coing to defend and don't or just do nothing. Either way they seem to just start putting money into your account in dribs and drabs.

Alarm fails to go off!

Tubes delayed and even later to work!

Very bad day at the office!

You get home from work and on the door step is a letter from Nationwide. What do they want now, money, bank charges, their defence.

 

But NO!!!

They are not even going to close our account like they have been known to.

After winning against the Nationwise, we today received a very nice letter from them stating their intention to close our account.

 

Here is my reply to them to be posted to them tomorrow:

 

Your comments on this letter are most welcome.

 

Thank you for your very kind letter of 6th February 2007 regarding you intention to close our accounts with yourselves.

We are truly shocked that you intend to take this action.

The legal action we took against yourselves was not regarding the conduct of this account, rather the regime of 'fees' you operate and if they were lawfully and in a manner which complies with UK law.

By not contesting this in a court of law, and repaying these to ourselves, your organization has admitted to these charges being unlawful.

If as you state in your letter that we as your customers are “unwilling to conduct our account in accordance with your Flex Account Terms and conditions”, you also have broken your own terms and conditions.

We therefore argue that your intention to close our account is a malicious, disproportionate reaction to our “penalty charges” complaint. You have acted against the advice of your own professional body; The Banking Code Standards Board. (We note that the Abbey have stated that they will be following this advice). You may want to note that the Ombudsman has just adjudicated in a complaint against the Alliance & Leicester on a complaint that the A&L closed a customer’s account in response to a claim for bank charges. The FOS decided that the closure was indeed unfair as it was punitive and retaliatory.

We hereby serve notice that unless we hear back from you by Friday 16th February that you have reversed this decision we will take the following action.

· File a complaint with the FOS.

· Take out an injunction against this action and sue for damages.

· Start a leaflet campaign outside your branches advising customers how to reclaim their charges and where to get advice.

I would take out the last bit about leafleting outside the branch as you may have read in the campaigns bit, but apart from that seems ok

If U feel so strongly inclined, U have my whole-hearted support!

It costs Nationwide for every complaint.

There is the OFT approach also, I believe?!

U would have to quantify the damages in monetary terms.

The injunction may take time and money better put to use elsewhere?!

· Start a leaflet campaign outside your branches advising customers how to reclaim their charges and where to get advice.

NOT advisable on legal grounds!...Also, who pays for the leaflets btw???

I think it's really bad that NW want to close your account. They have admitted their charges were wrong when they gave them back to you.

 

I hope your letter works but I have to agree that the leaflet campaign would not be a good idea. You may attract Police attention and I'm sure that a good citizen like you wouldn't want that. I do totally agree with the principals though.

 

I'm chasing them for £120 so I will let everybody know the outcome.

OK, Here we go.

 

After appearing on Watchdog 20.02.07 I again contact Nationwide to see if they had changed their mind, but they still aim to close my account.

 

I am now planning to get an injunction against them and sue them.

 

If anyone has any idea's on the wording I should use and how I go about this please let me know.

 

Just in case I have reactivated an old Woolwich account, which will be great when Woolwich pay up as well!!

 

Will update once the next stages start, but I am now planning to leaflet Nationwide branches, but I am now very good with Words.

Have U also NOT considered going down the route of starting and leading a campaign to have the Nationwide De-mutalise???

They are STILL a Building Society and should be putting their members 1st, as they have no shareholders to make profits for, and therefore, even more so, should NOT be debiting unlawful Charges and closing accounts!!!

Despite any caveats with regards not receiving any benefits from any potential floatation. It should be remembered that Nationwide's % rates are not market leading.

Just imagine how the Nationwide Board would squirm @ the thought of 100,000 CAG members having Flexaccounts and forcing the Board to seek alternative employment if they were not to change their current policies??!!

Am sure that U may have more success than your proposed local Demo?!

Hi there, im currently in the stage of reclaiming charges from nationwide, and im at the court stage, and was wandering where i get the template for completing my N1 form. Also does anyone have the excel calculator for calculating my interest?? any help would be very much appreciated:)
