Hi all,

 

Just to let you know where are are v Abbey.

 

DPA letter sent 16th Oct

Rec letter 06 Nov that we would receive 14 months of statements shortly and the remaining had to be got from Microfiche.

 

We received the 14 months worth of statements within days but we are still waiting on the Microfiche copies.

 

How long should we wait for the remaining statements?

 

Should I start a claim for what we currently know or wait for remaining copies.

Gosh you certainly are busy this saturday morning aren't you!!!!

 

You are better off setting up threads in each differen't section of the forum to do with the banks you are taking on. It makes it easier for you and the mods/site helpers when you have questions etc.

You're taking on quite a few aren't you? so, just post a new thread in each section to do with that bank. You can't copy and paste (I can't anyway) so you'll have to type it all out again. It's best to do this though, then you and everyone else will know exactly where you are up to.

The very nice people from Grabby sent us a letter last week offering us the very laughable amount of £695.00.

 

To make matters worse as this account was sent to their debt collectors due to bank charges causing the overdraft and our refusal to pay them got worse they will pay this some to the debt collectors directly.

 

They will get sent to them a letter before action tomorrow with the revised claim less the debt collectors value and thanking them for their provisional settlement.

 

Will update you all when I know more.

Hi all,

 

This has taken a while because of letter going back and forwards.

Any ideas on how I do it because of the situation. Shouls I claim full amount and wait for them to do Counter Claim for the value we owe them or combine the two values and Claim the diference?:?:

What, you mean do you take off what you owe them through overdraft or other such debt? No, you don't. Claim the full amount they have taken in charges, minus any goodwill refund you might have had.

Grabby have acknowledged claim.

 

We then received a vrey nice letter from them yesterday to say they needed our contact details?? they already have those & wanting a breakdown of the charges and interest!!

 

Sorry Grabby, I am not as dumb as you are. Following a post I saw on the site I droped the MCOL into my local branch with the calculations and interest sheet. I got them to stamp and sign each page as received and took copies!

 

In the letter back to them I enclosed copies again and told them they should have reveived this all if their internal post works!!!

 

They also said they were going to defend! OH I'M SO SCARED!!!!!!!

OK the latest here.

 

I have an allocation hearing (what ever that is) on the 20th April.

 

There is also an attached sheet with the following:

 

"This case has been listed with other cases on the same occasion because it appears to District Judge edit that the main issues involved in all of them are the same" etc etc etc

 

It means I think there will be a few of us there on the same day. If anyone there is due in Kingston upon Thames Court let me know.

Hi, read all about Allocation Hearings here : PRACTICE DIRECTION – CASE MANAGEMENT – PRELIMINARY STAGE: ALLOCATION AND RE-ALLOCATION - This Practice Direction supplements CPR Part 26

I suspect that because your Judge is grouping similar cases together like this, he's trying to use the Allocation Hearing to flush out the Banks (they won't all necessarily be Abbey). You ought to go, and I would prepare by being ready to talk about your claim resting on whether Abbey will disclose its costs associated with your defaults (going over your overdraft limit). Overall, I think that the Judge is probably doing you a favour. Regards, Mad Nick

With the AQ hearing date approaching 20.04.07, we received a letter from Grabby offering full settlement of £5,769.12.

 

I await the cheque!!!

Unless you have received cleared funds by the court date then you should attend - tell the judge that they have indicated an intentionm to settle but it has not come to fruition yet. He'll probably grant a 14 day adjornment.
