With it being older than 6 years HSBC don't have any way of confirming anything that would be on a statement, I can't get proof of anything so memory is the only way I'm afraid.

 

 

It would have been through a direct debit through an old account with HSBC which also closed and went the same time as everything I had with HSBC was closed.

well wouldn't hurt to ring and ask then.

we've had it before where by you ring again

get a different operator

and they are more familiar with finding old stuff.

no harm in trying

your defence is not due till Friday 4th august

Well if you cant get the info and HSBC cant..lets hope Arrow have no surprises and so go a head and file the SB defence.

The following defence is all you need if it is SB

 

1 The Claimant's claim was issued on (insert date).

2 The Defendant contends that the Claimant's claim so issued is a claim in contract and is statute barred pursuant to the provisions of section 5 of the limitation act 1980.

 

If, which is denied, the claimant contends that the Defendant is in breach of the alleged contract, in excess of 6 years have elapsed since the date on which any cause of action for breach accrued for the benefit of the Claimant.

 

3 The Claimant's claim to be entitled to payment of £[insert figure from their POC] or any other sum, or relief of any kind is denied.

I've had a reply from Arrow.

They claim the debt isn't statue barred as my ex was making payments up until 2014 then she stopped and they can't find her!

They have said that they would rather deal with me one to one rather than going through the courts?!

 

This makes me think that with the debt being so old (2001) that they don't have the relevant paperwork to prove it.

 

I'm adamant I don't owe this money,

everything I owed from that period was paid back,

when I went to the bank they said this was a loan,

 

in the letter I've received they say it's from an overdraft,

I never had an overdraft with the Halifax?!

What should my next steps be?

claim is stay

safe to ignore them

but not the court.

twill cost them more money to lift the stay.

Silly bleeders! If they were 100% confident that it WAS'NT SB, then they would issue the claim, instead of willy waving and sending out pointless meaningless threat letters.

 

Certainly safe to ignore the chancers.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!
