    • Thank you Man in the Middle, Everyone I know this may not make a difference but is it worth mentioning the fact i did believe i sent everything correctly but with all going on with my mother at the did not realise that stamp was not valid? Also the SJNP notes say they sent a reminder i did definitely receive this if i did it would have prompted me to realise something was wrong and rectified. I have to fill the form in online today so any more advice is gratefully received. The area is Gwent in South Wales it states on the form if i plead not guilty then send me the date of the trial Sorry as i've stated previously totally new to this and thank you for you assistance  i know you cannot say for certain but realistically by pleading the above what would be the most likely outcome be ? is it still likely to be 3 points and £100 fine ? or am i likely to receive higher and more fees?
    • Vennells evidence starts this morning at 09.45. Nick Wallis has made an interesting observation in his blog yesterday or today that yesterday's witness, Alwen Lyons, implied that forensic accountants Second Sight weren't doing a good job on their investigation of SPMs' complaints about Horizon. Nick's theory is that not being good at a job seems to be telling the Post Office things it doesn't want to hear. And that having been told things they didn't want to hear about the Horizon system, that training was terrible and their investigators and prosecuters weren't good enough, they decided the solution was to sack Second Sight and buy more expensive advice in the hopes of getting an answer they liked.    
    • Thanks for the quick response! the way they’ll have found so far is LinkedIn, I use this for business and work etc. I’ll have to look into the settings and see if I can make this more private I have no other social media.    so to confirm, best step is to directly mail my address to emirates and HSBC directly then ignore idrww and judge and priestly? should I be telling both the uk collection agencies that I’m only going to be dealing with the banks directly and not with them?    would you recommend creating a monthly payment plan to the banks or not?    Thanks,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all!

 

Thanks for all your advice on these forums! They've helped a tonne and I've tried to keep well informed. I thought I'd just ask for some advice to make sure that I'm not doing anything wrong

 

26 Nov 2015 - Xercise4Less Membership for 12 months

26 Dec 2016 - Last payment made of £9.99.

 

At this point I filled on the form online and cancelled my DD. And then the troubles and the letters started...

 

28th Jan 2017 - I sent a letter to Harlands using the templates I found on here stating:

- I cancelled my DD on 28/12/16 as adequate notice of my cancellation of gym agreement

- That I will offer a further £9.99 if they confirm in writing in 14 days this as full settlement of all amounts due.

 

1st Feb 2017 - Letter from Harlands stating that "All cancellations go through the Xercise4lEss website and that unless they have confirmation from the Xercise4Less head office to cancel, they cannot action my request"

 

As per advice from this forum, I've ignored all further emails, letters and phone calls.

 

9th Jun 2017 - Letter from CRS stating an account balance of £171.47 and that I have 10 days before the balance is passed onto Zinc.

 

I'm pretty sure that I should ignore further letters but was just wondering if there was something I missed or something that I should do?

 

Again you guys are great! :smile: Fortunately I have the means to pay for this if it came to do it but I am not paying out of principle but it makes my blood boil to think of the kind of people they manage to extract money from :|

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

As DX says above (twice !!), ignore their demands.

 

You'll see from other threads here how they'll continue with their begging letters.

 

If you fancy stopping Harlands in their tracks, court action against them is cheap and simple. Let us know if you're interested in this option.

If I wanted to take court action, how would I go about doing it? (Out of interest more than anything!)

Pretty cheap and you'd have a good chance of success. In that case, Harlands would HAVE to cease further demands or harassment, which is what most folk here want.

 

Sadly, this isn't a course often taken but I'm hoping we can improve on this ........
