Hi there,

 

I have just received a letter from Howard Cowen being requested by Robinson Way LTD.

The letter is Notice of pending legal action.

 

 

The debt i owe is £11,834a nd they are saying they want me to make a full payment within 14 days or if unable please contact our client's agent Robinson way to discuss an affordable payment plan.

 

 

If i am unable to pay this account you must still contact our clients agent RW to discuss your options which may prevent legal action being taken.

Failure to respond to this letter will result in legal proceedings being issued without further notice.

 

I obviously have not got the funds to pay this debt and have managed no contact with them for around 5 years. they have however finally caught up with me and are now threatening County court and ccj against me.

 

Can you please advise me on what to do next as i have no clue and i have just been avoiding this debt for so long.

who was the original creditor

when did you last pay anything

whats the defaulted date from your credit file?

It was with Barclaycard but it is now with Robinson Way ltd.

I last paid the minimum payment around 5 years ago.

I am unsure what you mean by defaulted date from credit file?

I have had a letter today and do not know what to do next to be honest..

read the letter again

I would suspect it doesn't say WILL court anything but MAY.

 

 

but regardless there are 100's of thread there exactly the same scenario

and even if they do issue a claim

its easily defends

just for background

Rway/hoist/cohen are all the same lot at dif desks in the same office

same printer

and most probably the same PC spewing out the threat-o-grams.

Have you ever sent them a request for a copy of the agreement (section 78) request ?

and what is the defaulted date was the original reason for getting the report

what is it please?

 

 

as you've never contacted them

you need to now!!

as when /if you move from the address that you originally took any credit out at

you should ALWAYS tell each creditor on your file the change.

else they can quite legally issue a backdoor CCJ to your old address

you need to send them a CCA request.

I have just looked at my experian account on the credit score and it says i have no ccj's at present?..

 

Well you need to follow the advice the team are giving to make sure you don't get one especially if you have moved from the address you took the card out on.

 

When did you take out the card before or after 2007?

Hi and thank you for your response. I think i took the card out in 2006...So do i need to send them a cca request like stated by one of your colleagues? I'm sorry as i really don't know what i should do next and any advice would really help me.. Thanks

no it goes who is shown as the owner on your credit file?

 

 

is this debt showing

and what is the defaulted date please

right so its probable been default more than 6yrs ago and been removed?

If that is the case then that is a good thing correct?

 

the info i have for you is that i have not payed nothing on it for at least 5 yrs. Although i took the card out around 2006 i think. I lived in 4 different addresses whilst i had the card and was paying it.

 

I have done the 30 day free experian credit search and it has no ccj's to date on there. But since i have moved to this house through a letting agent I have been having letters from Robinson way..

 

First ones were asking me if i was the name to this debt and then offering me to pay a certain amount off to now having the notice of pending legal action.

 

So i really do not know what to do next as i am uncertain if i have had no contact for over 6 years but it cannot be far off if so. I was told if i did make contact with them i may be opening a can of worms because i maybe near the 6 year void?

 

Really do not know what to do for the best. So any advice would help me from you guys.

Ok Thank you i shall take a look at this tomorrow and copy it out to send then if you think this what to do next in my circumstances. Thank you for helping me and appreciate if you could tell me what happens after this to your knowledge.
