My pal was made Bankrupt early 2001 and discharged under the old rules.

This dropped off her Credit File after six years and nothing is shown.

However, yesterday she received a letter from McGinness Associates referring to her Bankruptcy and PPI:

"We would like to make you aware, that after being discharged from your Bankruptcy, you are now entitled to claim for compensation for PPI".

Personally, I take this as an Invasion of Privacy.

Does this firm go through old copies of the London Gazette?

Being so long ago my pal had more or less got over her bankruptcy and is very upset at being reminded about it.

I'm ready to blast them but I want to know where we stand,

can anyone offer up some advice;

and for the record,

no,

she hasn't had PPI.

Am I right about the London Gazette or have they trawled elsewhere?

Joe

you DONT need a reclaims company to nick upto 50% of the returns.

I wouldn't use a claims company but she didn't have PPI anyway. She's just annoyed that they;ve brought this up after all these years!

Was the PPI mentioned for any of the creditors in the Bankruptcy and specifically that period?

If it was to do with any of your creditors during your bankruptcy period please be careful as this would still be classed as an asset by the Trustee appointed by the court at the time even if you have only just become aware you can claim PPI. (if it was for that specific bankruptcy period).

If it was for during that bankruptcy period it does not stop you in any way writing to the Trustee to ask for there permission to reclaim the PPI. they will either say Nop it's ours or not interested so to speak so don't be put off reclaiming just be aware of the above.

Your more than welcome.

I can appreciate the friends surprise to suddenly have this mentioned as bankruptcy in whatever circumstance can be such a stressful time, as for how they got this information as it was bankruptcy (through the court) it would be public record so they could have got this information from different sources including the Gazette.

Was the PPI mentioned by this company for during that bankruptcy period?

Cheers. No specific period was mentioned, just "your bankruptcy".
