    • Ok, so as you have been overcharged you now need to be pragmatic and first of all request a refund by making a complaint.  In this first complaint do not go on about what argument you had and what conduct the inspectors were following.  Concentrate on highlighting the fact that you must get a refund because they overcharged you.  People looking at complaints receive thousands everyday and anything longer than a few lines is usually misunderstood.    After you receive your refund, then you complain about the conduct of the inspectors,  as a completely separate matter. I note that you were offered a refund, an argument broke out and you were escorted out of the station. This will not play in your favour as all inspectors would have taken note of this in their notebook and possibly complete an incident report form with their version of events. Frustrating but that's how it is, that's why I said to be pragmatic. 
    • agree with DX100uk on the reply. Every time I have replied or complained about those firms to the FO and FCA they take an age to come back and even then its with nothing new as they cannot do anything. for what its worth my debt is over 70k and even that has been inflated ! so no worries there. There are many thousands out there in the same situation.   In regards to COB and even Stepchange don't even bother as they have no idea themselves something which I complained to the FO about as CWD and IDR use in there letters to seek advice when they know full well that no charity or debt company know anything about the debt in dubai situation so this is again unfair to be using this. what also annoys me is that nobody ever signs off letters its IDR or Moriaty law etc !!!!    I have never supplied my financial details and never will and only when and if and I will repeat when and if that the debt i owe is purchased by a UK firm or indeed taken through the correct channels or courts then I will defence myself.   It makes me alugh that they think a small c;laims court understands everything that goes on and dont understand the full picture of laws that are broken and sometimes human rights also.   The best one to date for me was in 2011 imagine my new job and my new partner and some stupid collection agency in Dubai send a Fax to my director about my debt !!!! embarrassing but at the same time good to get it off my chest. they then called my partner in her work !!!! (yes this was the first time she found out about everything again good to talk) against the law, against any laws but this is how the banks and the agents work similar to those of CWD, IDR and I think Moriaty    dont pay a penny !

    • Your Rent. Bills. Council Tax etc 99.999% important.  Moriarty  0.001% important. Don't take food out of your kids mouth's to pay them.

Hello, I hope I have posted this in the right place!

I am utterly upset and shocked by this letter.

 

Today I have received a letter from Northampton County Court advising that I owe £534.24 plus costs to UU.

 

Now I do not dispute this bill at all as it is my annual 2017 - 2018 bill

 

 

however my issues are as follows;

 

- I had a zero balance with UU up until the most recent bill was issued on 1st April

 

- The bill itself stated that I needed to pay £267.12 on 1st April and £267.12 on 1st October

 

- I knew I wasn't able to afford the April payment

so called them to arrange a plan to pay this off at £66.78 per month starting from the end of May running until September as my payday is 28th of each month.

 

- As far as I was aware this was agreed

however I didn't get anything in writing and more fool me,

I didn't think this would be an issue.

 

- I have not had any reminder from UU

 

- I have now been told I have to pay the £534.24 plus £130 court costs which is for my bill up until 31.03.2018!

 

-Can they give me a CCJ for a service I haven't had yet?

 

- I dont have any proof of this payment plan as it was all done on the phone

(i feel foolish now but they tell you to call them if you cant pay so I did)

 

- How do I reply to this court letter?

 

- Do I make the £66.78 payment at the end of the month?

 

I do not dispute the bill of course

but I cannot believe they have done this to me and I dont know what to do.

So basically its your latest bill which they wanted in 2 payments.........how have you paid the previous years ?

 

Do you not use Direct Debit ?

 

Did you not ask to pay it over 12 payments ?

 

Do you not use on line facility to control your account ?

Seems very over the top action.

 

If you have an unmetered service contract, in theory yes they can issue a court claim for the full year, if you don't enter into a payment arrangement.

 

But if you were going to start paying by instalments from the end of May then it seems the court claim was issued in error.

 

You need to contact their team that deals with payments and i am sure they can resolve this quickly with the court claim withdrawn.

Depending on the amount of water usage, you might be better off asking for a meter to be installed. Then you pay for what you use and don't have the possibility of a court claim for a long period of unmeteted supply,

i am fully aware it is a claim form hence why the title of the post was a claim form. Apologies if my terminology is incorrect!

I an sure UU can resolve this quickly, if you had already made contact with them to set up a payment plan.

 

Water companies on a unmetered supply won't allow no payment arrangement to be in place and will issue a court claim, but they usually warn about this first. I think they have made a mistake in issuing the claim, if you have already arranged repayment by instalments.

 

If UU are not helpful, just acknowledge the court claim and defend in full. The defence is that you have already agreed payment by instalments before they issued their claim.
