Hi LBL , First of I would like to thank you for the information it was most helpful however as I am in Scotland I am not sure how much of this applies to me .

 

The bailiff watchdog have tried to get the information we need from log book loans using the SAR methiod but Log Book Loans have no replied with the information and they have now runout of time so we will have to wait and see what happends next . Thanks Alex

If you say they have changed their charges to £12 a letter recently does this mean they will refund the difference of all the £20.00 charges that they charged previously , I have finished my loan with them now and want to get some of these charges back?

I don't know if anyone has tried this, but I would imagine so, as they have changed the charges in response to the OFT's dictate that they would investigate anyone charging over this. Write to Paul Foster at Logbook Loans, Bridge Studios, 34a Deodar Road, Putney, London SW15 2NN. Copy your letter to Mr B Pilgrim (MD)

thanks for that it still seems as though £12 is a lot to be adding on weekly even when payments are being made for normal weekly payment and then an amount agreed towards the arrears but then to be continued to be charged £12.00 anyway. But I will write off as this still works out that I should be able to get at least £200.00 back which is the difference between the £12.00 and the £20.00 which was charged to me for 20 weeks in a row.

So you were being charged even though you had made an agreement to pay off the arrears? You should not have been charged during the payment plan if you were paying what had been agreed on time.

 

Go for the full amount.

OFT wrote to me today and said if they get more complaints about Log Book Loans they will look into this . The person who got back to me is OLU Ademolu he said anyone with problems with log book loans should e mail/write to OFT so please write to them and complain . Alex

That's great caprikid - if anyone who writes to the OFT uses the License number reference, it will be applied to the same case and therefore strengthen the argument.

I've been asked a question via PM regarding insurance, I won't identify the user but will post the response here as well for the benefit of other forum users who may have a similar query.

 

Logbook Loans list Fully Comprehensive insurance as a requirement for getting the loan. This is to protect their "interest" in the vehicle, as if it is written off they will apply to the insurance company for settlement of the loan before you get any settlement yourself. This will result in the borrower receiving a reduced amount from the insurance company, depending upon the outstanding balance at the time, especially if the loan is in its early stages. If, as the person who originally asked the question, you only have 3rd party insurance, then they will default you immediately that the car is written off and you will have to pay the full balance.

 

Edit:- I've given this some more thought as a result of another PM.

 

Although Logbook Loans put themselves at a higher risk by writing the loan when a customer has only 3rd party insurance because if you had had an accident that was your fault and the car had been written off they would then have lost their security in the loan, the representative would have known that as soon as you signed the Bill of Sale you would have been in breach of its conditions, so there's a possibility that its validity could be questioned, but that's an issue for a more qualified mind than mine.

 

It's worth taking advice on.

As a family with three vehicle with cherished numbers, I can assure you that if the vehicle changes owner before the number is transferred or placed on retention, then the ownership of the number transfers to the new owner of the vehicle - it is then too late to claim it back unless they are willing to sign transfer documents and present the vehicle for inspection if necessary.

 

You must have ownership of the vehicle or the owners signature on the necessary docs in order to place the number on retention. All the paperwork that you get from the DVLA tells you that you must not sell or transfer the vehicle until the transfer is complete (retention certificate or new V5)

A quick pointer for Nellie, and anyone else claiming. If you get copies of signed documents back from either Logbook Loans or the Royal Courts of Justice check them very carefully for alterations. Any alteration to either the loan agreement or Bill of Sale in pen or pencil renders the document unenforceable.

i need some urgent help..

 

log book loans have made my life hell of late..

 

i was paid up until last jan as per their letter ..then missed a couple of payments and heard nothing..then todsay they tried to take my car ..recieved a letter saying my agreement is terminated..no warning what so ever or did they send any letter either..

 

they do not respond when u call ..when u do get through they tell u to pay now or we collecting the car..

 

im very worried as i only owe 1900 and the car is worth 25k..

 

also we have asked for a settlement figure but again they is no reduction hardly.. we have them to to justify their settlement figures but again refuse ..only threatening my wife in the process of pay or we take it away..god help them if they call round as im going to get very physical indeed with them if they think they can remove our car after they have cleary broken the law.

 

can somebody give me a legal firm to call for advice or a solicitors numbers please who deals in this field.

 

im appauled at their bully stlye tatics ...

 

my car is at home so im worried they make try and take it tonight whilst im asleep..

i want ot sort this out but they simply r playing games with us

 

i need some urgent help... im local in london so unsure what to do...i dont want them to turn up in west london unannounced.

They will take it , they did'nt take mine but I moved address after taking out the loan so they would not have found mine anyway , my first advice would be to move the car , do you have a relatives you could put it at for a few days , ring the law society and ask for a solicitor for that specialises in debt matters , or book to see trading standards asap, they may intervene for you.

It doesn't make any difference whether you are in London or Glasgow, they will turn up anyway. (I'm confused, are you in West London or North London? as your posts contradict each other.)

 

You say you missed a "couple" of payments. How many payments did you miss? Did you make an arrangement to bring arrears up to date?

How did they try to take your car? Were you at home at the time or did they speak to your wife about it?

 

 

BTW: Do not attempt to get physical with anyone - if you do, all that will happen is that you will lose the car and get arrested into the bargain.

I just asked where in London you are as I have used a Solicitors in the past called CLC which I think stands for Community Law Clinic and they had specialist debt solicitors who I was referred to by Citizens Advice to help me , this was quite a few years ago but they still do this type of work they are in Kensal Rise on 0208 964 4222, they were able to help me negiotate payment plans etc to clear all my debts. They were very reasonable and accept Legal Aid client's too.

well that Solicitors should be very close for you its on the bridge in Kensal Rise, NW10.

 

I would make an urgent appointment for a consultation which will not cost anything , and move the car in the meantime, they will probably come tonight or in the early hours of the morning to clamp it. You should have received a default notice. when you say you were paid up to last Jan ? do you mean Jan 06, then how did you miss payments?? had you finished your loan with them?

I had a loan with them and did fall into arrears but I must admit I phoned a lady called Nicky in their Collections team and came to arrangements to pay arrears and current weekly payment and she was actually quite friendly after a while but i called her about twice a week to check we were still ok on the arrangement , and after a long hard slog paid it off and all the charges , but as I said I moved anyway so they could not clamp me car and so I will never know if they actually tried to do that sneakily, they probably did try but could'nt find it..

they arent willing to accept aqnything but full payment ..i think its a ploy for them to take my car and i think they r tryinhg to buy it for themselves.

 

they refuse to listen just insisted full payment with in 24 hours ..no other warnig no final demand letters nothing..im ost certainly taking legal action and iver contacted watchdog uk regarding this..log book loans simply make the rules up as they go along,

yes but have you moved your car....while you try and get an appointment with Citizens advice etc, otherwise you will be on here tommorrow and it will be gone. How many payments did you miss , did you ever call them , if you bury your head in the sand with these people then expect the worst then you just fall into their trap,
