I have received court claim form. For a debt that's not mine. It's for a similar first name, same surname at my address.

 

The claim form states it's for a catalogue debt.

 

I have checked my credit report and it is now showing there. I have never received any correspondence for it

 

I'm frigging furious and how to I stop this happening

I cannot copy as I'm on a phone but I moved 6 years ago.

 

The claim is Lowell solicitors on behalf of Lowell portfolio ltd and the original company name is j d Williams.

 

The claim is 1500.

 

They say I had an account with JD Williams and I didn't pay.

 

The claim form was issued on 11th

This is what is needed below. Suggested you contact JD Williams to make a urgent request for information. Subject access request if needed. Flag it up to them, that you believe that there may have been identity fraud, as you never set up an account with them, yet Lowell are chasing you for a debt.

 

 

In order for us to help you we require the following information:-

 

Name of the Claimant ?

 

Date of issue – top right hand corner of the claim form – this in order to establish the time line you need to adhere to.

 

Date of issue XX + 19 days ( 5 day for service + 14 days to acknowledge) = XX + 14 days to submit defence = XX (33 days in total) -

 

^^^^^ NOTE : WHEN CALCULATING THE TIMELINE - PLEASE REMEMBER THAT THE DATE OF THE CLAIM IS DAY 1 [example: Issue date 01.03.2014 + 19 days (5 days for service + 14 days to acknowledge) = 19.03.2014 + 14 days to submit defence = 02.04.2014] = 33 days in total

 

What is the claim for – the reason they have issued the claim? Please type out their particulars of claim in full (verbatim) less any identifiable data and round the amounts up/down.

 

What is the value of the claim?

 

Is the claim for a current account (Overdraft) or credit/loan account or mobile phone account?

 

When did you enter into the original agreement before or after 2007?

 

Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim.

 

Were you aware the account had been assigned – did you receive a Notice of Assignment?

 

Did you receive a Default Notice from the original creditor?

 

Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ?

 

Why did you cease payments?

 

What was the date of your last payment?

 

Was there a dispute with the original creditor that remains unresolved?

 

Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management ?

I only got the form today in the he post, presume it was deliberate due to bank holidays.

 

I presume AOS is acknowledgment of service which I have done through my phone, I don't have access to a pc until tomorrow

 

I checked noddle and it's showing up there.

 

The first name on the claim form is an abbreviation of a name similar to mine.

 

i have not heard of J D Williams and seems they are a catalogue company.

 

Can I email them to get a copy of any paperwork, do I contact Lowell or J D

no you don't contact JDW

 

 

pop up on the MCOL website detailed on the claimform.

.

register as an individual

note the long gateway number given

then log in

.

select respond to a claim and select the AOS box.

.

then using the details required from the claimform

.

defend all

leave jurisdiction unticked.

click thru to the end

confirm and exit MCOL.

.

get a CCA Request running to the claimant

leave the £1PO blank and uncrossed

.

get a CPR 31:14 request running to the solicitors

.

don't sign anything
