    • Hi I have decided I don’t want to use this company, however they say a refund takes 5-10 working day, however as we don’t have much good weather I want to buy the machine form a more reputable seller ASAP, is there anything thing I can do to remains a quicker refund. The machine cost over a grand so I don’t have any spare money to be paying for both machines.

Yes I believe so   Did you receive a Default Notice from the original creditor? Yes   When was your last payment:-  I believe I made at least one payment in late 2015 after having been late in submitting deferment forms that year   Why did you cease payments:- I only made payments to cover a couple of months' payments which were due because of my deferment had been submitted late. I stopped once those payments had been covered   Was there a dispute with the original creditor that remains unresolved?  No   Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan?  No    
    • I emigrated to australia permanently about a year and a half ago, but still have an overdraft of 2500 pounds with a bank in the UK. I am struggling to pay it off, and am being charged 1.75 a day for the overdraft. I have not informed the bank that I have moved to Australia.   Im wondering what is the best course of action. I do not intend to return to the UK and have no assets or family over there. I rang up a call centre for the bank and informed them of my situation and they suggested i ring the branch and speak to them. I intend to pay the debt off, but am not in a position to do so right now, and was hoping the bank might put a hold on the charges, whilst I can get the finances to pay them off.   alternatively, what would happen if I did not pay this debt off
    • is the property jointly owned and the all the CO's/debts are in your sole name?  
    • Oh dear I didn't know that about Word - thanks for the tip. I would be grateful for any other comments re the text. Thanks for getting me to this point. I now have a huge amount of info to plough thru to prepare for the next stage. Is there any guidance as to what happens next and how long that takes, or will that be made clear once the basic defence has been submitted? I haven't been able to find a clear explanation of the procedure anywhere.

Shire Recoveries DCA adding Charges to old trade debt.

Good afternoon.

 

I owe a trade supplier £200 for goods I have received.

 

I have returned stock to the value of £139 which they have agreed to credit me with.

Therefore I owe the supplier £60.

 

However they have got a DCA to chase me and the DCA are claiming £566 presumably made up of some jumped up charges.

 

I have asked the DCA to confirm what I owe for Goods supplied but was wondering what else I should do?

Ignore the DCA...deal with Trade Supplier Direct.....DCAs cant add anything on...your contract is with the Trade Supplier.

Thanks for your reply Andy. DCA are trying to get £324 compensation! I have remitted the £60 I owe directly to my supplier.

dca's have no interest in any matter so cant add any amount to a bill. The original creditor may add certain charges but this is prescribed so it cant be any random amount.

Dont have anything to do with the dca, they will eventually have to go away as they have no alternative

I had this issue a few years back,

not one of the big companies

 

The guy I spoke too add £30.00

I simply told him I have no contract with him,

if he wanted his fee get it from the company who approached him

I cannot believer Shire Recoveries !

they threatened me with all sorts whilst neatly omitting that they would need to actually take me to court for their charges and win.

 

I wrote and pointed this out to them and that I had no contract with them.

 

I thought they had seen sense and given

but oh no today I am getting the 'urgent' call to call their litigation woman back immediately!

 

Should I report them to the FSA for making demands and action?

The Office of Fair Trading had a document giving guidelines to debt collectors collecting consumer debts

Several things you should note;

 

1) The OFT is no longer in existence

 

2) Your debt is a business debt, not a consumer debt

 

But read through the guidelines and understand the general principles laid in the guidelines.

 

Get them to follow the guidelines but don't mention where you got the idea

 

Reasonable behaviour is a legal requirement in every conduct

 

The more you point out that they behaviour is unreasonable the more likely they are going to leave you.

 

Ignoring them is a big risk

 

people tend to ignore them and they just take the case to court, hoping you wouldn't turn up on the day.

 

they usually get default judgements a lot of the times so they are always quickly to go to court.

 

Best you talk to them now so that they don't take you to court as it would be a big waste of your time,

I have never ignored them and wrote to them explaining my position and a copy of my last statement from my supplier which confirms the amount..

 

I will not discuss the matter on the phone as per advice here and elsewhere .

 

They have been calling me for 12 months but now the debt is paid £200

they say I owe £466 in charges

 

. This demand has never come from the company only the DCA.

I wouldn't really advice such step

 

Some one said 85% of small claims go undefended hence most lawyers just send cases to court in hope of getting a default judgement (I can't independently verify that stats though)

 

I don't think you would like the stress of going to court even if you win

however...this is a DCA making the threats

they can be safely ignored totally.

 

 

a claimform would come from the company themselves

entertaining DCA's gives them some kind off false grandeur....don't!!
