    • deed?  you mean consent order you and her signed? concluding the case as long as you nor she break it's conditions signed upto? dx Yes sorry. they called it a deed at first in court.  Then Judge said she was happy to have it sealed as something else  exact names of orders in message above.     The disease was tested for when his cardiac testing was done immediately after purchase and part of the now sealed case.   However, results were disclosed incorrectly and I only found out  two days ago.   This disease did not form part of my knowledge during the case as I had been informed of a normal result that was not the case.   it is perfect clarity of a genetic disease where as the previous cardiac issue could be congenital until the pup is genetically tested. 
    • Hi, Halifax recently sold a credit card account of mine to Cabot. I am unemployed and have no assets and was thinking of making token £1 payments for 12-18 months in order to drag things out a bit and reduce the chance of Cabot being able to get the correct CCA documents from Halifax if I requested them in future. However, I saw on the pages on this forum about defending county court claims that one of the standard approaches when defending such claims is to say “I had an account with bank X, but I don’t remember the details and so don’t know if I owe this debt…”.     • Hi, This may be the wrong place for a thread BUT If you receive a defence, can you send a CPR 31.14 request for document mentioned in the defence, and then apply to proceed with the case only after (14) days passed or they respond OR is it only if you receive a claim I see @dx100uk thread is for when you receive a claim, but can you also do the same when you receive a defence?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Alan,

Have today sent my Letter Before Action to Lloyds TSB.

After my prelim letter, I got a standard "We're sorry to hear about your complaint..." letter. Today I received another "We feel our charges are fair blah blah.." and "no, we will not refund your charges blah blah..this is the bank's last say on the matter, blah blah". So bring it on. Will keep you informed- they have until 6th December to respond- OR ELSE!!!!!

I have not recieved any letter to date From LLOYDS but i will be ticking off the dates on the calender and getting my LBA Ready to post

Hey Alan!

Started a new thread the other day (steph v Lloyds TSB- how original!)

Basically our favourite bank moved my accounts to collections. Forced to phone them and then totally patronised by call centre worker on end of line!!

 

But don't forget their new motto (as found on the outside of some junk mail received from them the other day...) "You First!!!"

 

There is light mate.......

Basically our favourite bank moved my accounts to collections.

 

The same has happened to my account.

 

They are dead easy to fob off. I was getting calls every other day from them so, whilst remaining very polite, told them that they would not achieve anything by ringing or sending standard letters.

 

They can if they want put a hold on calls. Just tell them that you are waiting for another department to respond to your letters. If they take no notice, complain and make them work for their money!

What does it mean when your account is in collections, i have not come across this one, ?? I had a run in with my bank a couple of month's ago they sent me a letter saying that they could not pay one of my d/d as it would have taken my account into arrears of 12p and had the kneck to say if we could help in any way they would, i rang and spoke to someone at a call centre, and explained that if they did not charge £35.00 for cancelling my d/d then i would not be in this situation in the first place, and what about the help offered, well you can all guess what there answer to that one was.

Keep on making them have it you guys & Galls

Collections is basically just another department who pester you for the money back when you go overdrawn. Some of the calls come from TSB's 'Indian' branch! I usually ask to be put through to the UK as they usually struggle to understand my broad Yorkshire accent!

 

I've stopped using my account but it is slightly overdrawn because of some charges.

 

After a few weeks I finally got it into their thick skulls that I will not be repaying the money at the present time. Not a flat refusal but I have made them aware of what is happening. They are no longer threatening me and probably realise what is coming - a BIG FAT CLAIM!

However, I think they already know about the backing as I bought a sheet of C.A.G labels. They sure do look beautiful on the front of an envelope!

Hi, this is my first post, so please bear with me.

I SENT THE FIRST LETTER TO TSB ON THE 11TH NOV, GOT A REPLY, SORRY TO HEAR YOUR DISSATISFIED, THEN ONE SAYING THAT THEY WERE LOOKING INTO MY COMPLAINT, THEN NOTHING.

Today ive sent the 14 day notice letter, so see what happens.

Has anyone got any further than this with tsb, they owe me 5197.00

Just Recieved a letter from LLoyds Tsb as follows

 

Thank you for getting in touch with us. I am sorry you are unhappy about your account charges.

Like any business, we do make a charge for some of our extra services. When customers don't have enough in there accounts to cover a payment, this always means extra work and it has to happen very quickly. We have to agree to make the payment by setting up or increasing an overdraft, or tell customers we can't agree it. We feel it's fair to charge for this service.

 

Of course its only fair too, that we're completely open about any charged-for services before you take them up. Thats why we take care to give every new customer the latest guide to our charges. You can also get up-to-date details about fees and borrowing rates at all our branches, through our helpline and on our website

 

Just as importantly, we do everything we can to help our customers avoid theese charges altogether. I'm sure you'll know how easy it is to keep a running check on how much is in your account. Your free to get an up-todate balance at any of our cash machines, over the phone, on line and by weekly text to your mobile. If you know a payment is going to take you over the limit we have agreed, you'tr welcome to see if we can raise it- and we can usually give you an answer straight away. Again we can do that for you by phone, on line or at any of our branches.

 

You'v mentioned the new guidelines from the Office of Fair Trading on credit card default charges. We don't agree with OFT's thinking on this and we're still talking it through with them. But the important point is that the guidelines are about 'default' charges that people pay when they break an agreement with us. The fees we charge for dealing with your request to go over your agreed overdraft limit are not default charges because you haven't broken your agreement. They are our prices for the service we provide in theese situations.

 

I do hope you can see that we make our charging system as fair as possible and why I can't agree to cancel your charges.

Please let me know if there is anything else i can do. If we cannot come to an agreed soloution after this i will help you refer your complaint to the Financial Ombudsman Service for independant advice.

 

If you are happy with the way i have dealt with your complaint there is no need to reply to my letter. If i have not heard back from you by the 11/01/07, I will close my file, though i will be happy to reopen it should you come back at any point afterwards

Looks pretty standard Alan, which basically means it's a load of cobblers.

 

They're not giving you your money back, well, not yet anyway!

 

If I were you, I'd just send Debbie Gilbert a courtesy copy of your LBA. At least that way she won't close her file. Be sure to metion the backing you have from CAG and see if it provokes any comments!

hi i have my date forcounty court 22 dec but i need to find out what questions i am going to ask them also i am very nervous as my daughter started the ball rolling for me and now i am left on my own i am not very confident on the computer so please excuse any mistakes

Incedentally, I think I put in my own thread about making a complaint to Collection. Well, today I've had a reply from them and it is almost word for word, the smae as the letter you received. I'm now going to draft a letter that they will be forced to reply fully to.

 

By the time I'm finished, TSB will regret having taken me on as a customer!
