Hi , I also got a parking charge ,

 

I entered the car park at 8.07 in the morning,

while waiting for the building to open as I was on a training course,

other colleagues arrived at about 9am

 

we went in and registered to be told we needed a ticket ,

the first 3 hours where free ,

off I went ,

put my reg in the machine ,

it gave me a ticket for 3 hours ,

i did not think nor did it occur to me that I should of added the time I sat there in the car before I realised I needed a ticket ,

as far as I was concerned I left in enough time ,

 

a letter through the post from Gemini parking solutions,

the parking happened on the 21st of Feb 2017

the date of issue was the 1st of march given me 14 days to pay at a reduced rate ( for being 40 mins over ) ,

 

the notice did not get to me until the 3rd of march given me now 10 days to pay ,

 

my question.

Also is , what do I do ,

 

furious at my self for not realising but more so they asking for 60.00 for 40 minutes ?

 

Any info greatly received,

 

iv got until the Tuesday 14th to pay them .

Hi ,

it's a parking charge notice to keeper ,

it was on the 21st Feb at 11.48 ,

 

it was issued on the 1st march given me 14 days to pay a reduced fee ,

 

I did not receive the letter in the post until the 3rd of march ,

 

I have not replied yet nor have I paid anything,

no mention of freedom of act that I can see ,

and yes it has photographs of me entering the car park and leaving the car park ,

 

parking company is north county Lesuire,

and car park is on the grounds of west gate college west end on Newcastle upon Tyne

 

and there appeals body is operated in accordance with the bpa.

 

Hope this is what I'm supposed to if done haha �� X

 

Ps my mistake it does mention the protection of freedom act 2012,

 

 

I am the keeper of the vehicle but it was not me driving .

Hi , it's about a 20 minute drive away when roads are quite , I will try to google earth it but don't hold your breath lol the address of this place is Westgate College

Ps just looked on google and I no that this is a new thing that that had been done back end of last year so nothing on google earth .

it is rubbish and the parking company know this but their ANPR system isnt fit for purpose so they send out the demands based on false data.

they dont care, they just want the money.

 

You were given an offer of a contract from the venue that overrides Smarts contract.

The venue were happy to let you park there before the start time so you have not exceeded the 3 hours covered by the free ticket anyway

 

as the time before the issue of the ticket cannot be counted because there was no alternative for getting your free pass

 

so it is all about performance of the contract.

Smart couldnt issue the pass earlier so they cant claim a breach of the contract as it is their fault, not yours

Post up the NTK and we will be better informed as to what course to take. If it fails to meet the requirements of the POFA to create a keeper liability I would suggest to start with that but need to see the letter suitably redacted-ie your details and the parking co ref no removed.

NTK is not POFA compliant,

they have failed to say who the creditor is

so if you want to just mess them about you can write back and say that

 

"I have paid the money to the person who claimed to be the creditor as per the wording of the POFA so the matter is now settled as far as the law is concerned.

 

As Gemini are not the creditors for this matter you have no interest in it and should cease any further communication with me"

 

Then see what they say.

 

As they admit being just the managers/gophers then it is correct they dont claim to be the creditors in this matter.

 

Interesting to see what POPLA make of it when Gemini turn your "appeal" down.

With regards to the parking charge that is being appealed ,

 

 

the NTK that was issued on the 1st march 2017 given the keeper was not driving the car ,

14 days to pay the Said fine ,

 

 

the driver entered the carpark at 8.07am ,

and as the building was not open had to wait around until it was open and other colleagues arrived ,

under the knowledge that this person was told they could park around the back of the building free of charge due to the nature of the drivers job ,

 

 

on entering the building they where advised it was maybe best to get a ticket as well ,

this was done and displayed given the driver 3 hours free .

On leaving the car park it was done so with in the 3 hours ,

 

 

if any breach has been made then charging some one 60/100 for 40 mins parking is absolutely outrageous! .

 

 

The NTK was issued on the 1st of march

you shouldnt have elaborated ,

just told them they are rubbish at their job and leave it at that.

 

 

They can now build up a picture based on what you have said and use it against you.

 

 

Also, never tell them why their NTK isnt compliant, tell POPLA that and you sail through that point.

 

I hope that you wrote to them and didnt email,

never email as it gives then a method of harassing you for free.

Speak with the management team of leisure center - tell them you PCN number and reason why were you there. One email from them will cancel - I had similar issue mine got solved.
