, Please can I get some guidance.

 

I visited my grandchildren over Christmas and took them around some shops on a particular day.

 

Parked in a small car park outside Darlington Sports Direct.

 

It seems I overstayed by about 20 minutes.

they have sent me a letter asking for £45.00 going upto £90.00 if I didnt pay quick enough

 

. I read on here somewhere that I should ignore the first letter and wait for a second

. I have received a letter now from a dept collection agency wanting £160.00,

where do they get these prices

 

, what should I do ?

No, you dont ignore anything

, what you do is wait for a NTK

IF you got a ticket slapped on your car windscreen.

 

What you have is an NTK,

which we cannot read so convert it to a pdf

and a letter from a rentathreat dca,

who have no powers to do anything so can be ignored completely

 

The signage is garbage,

you pay a quid for 2 hours and the ret of the day is free according to the sign.

 

It fails to have the necessary conditions spelled out to form a contract and fails in other ways to be compliant with any code of practice so that can be challenged as well.

 

Not a lot to worry about really,

if you can repost the letter from Smart and tell us the date you received it we will advise what to do next

NTK is utter twaddle as far as creating a keeper liability goes and fails to make the grade for a NTK on several other points as well.

 

No mention of who the creditor is,

they say they may act as agents for the landlord,

 

well, if this is the case why are they asking for money when the landlord has to?.

 

What date did your receive the demand?

 

this is important as they have a limited time to issue it.

it is in time but the wording is not compliant with the POFA so no keeper liability created.

 

How you respond will depend on your attitude to taking these bandits on because they wont ever admit they are wrong or they lose all of their income stream because they rarely have any legal right to collect a penny.

 

It has been passed to DR+ so you can ignore them as said,

see if they use a solicitor to send you a threatening letter and if they do come back here and we will advise a suitable response.

 

Contacting them at present will not make them go away, it will encourage them to think that you are worried about their taradiddles

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

well they are asking for more than the contractual sum so why would you want to aay it?

Also, have you not bothered to read anything about Gladstones, even just to see who they are.

 

 

The 2 solicitors are also the directors/sole shareholders of the IPC, the trade association that Smart belongs to.

 

 

They have written not because they are acting in a truly dispassionate honest way but because they have naked self interest in this matter and stand to make money out of it.

 

 

Where do you think the extra £60 you are not contractually obliged to consider goes?

This is another debt collection letter,

not a legal notice and they are using their letterhead to cause this possible confusion of their role

 

When they send the next letter you will be responding but let them waste their and their clients money for the moment
