      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

am receiving emails and letters from Motormile Finance with regards to a QQ payday loan.

 

Just looking for some help on how to deal with them.

 

I have heard some debts come under the CCA and if they cannot come up with a contract then they cannot pursue?

 

iS this correct? Any advice much appreciated.

Hello welcome to CAG.

 

Emails can be sent to the junk folder, letters should be kept and filed away.

 

When did you take the QQ loan out?

How much?

When did you last pay anything toward it?

 

Why did you stop paying?

Did you inform QQ that you were in financial difficulty?

 

Have you checked your credit file? Noddle is free.

 

Have you responded to MMF at all yet?

 

What is the last letter they sent saying?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

i'm wondering what MMF are doing with a QQ loan.

 

you'll see in the QQ forum lots of debts were subject to irresponsible lending and subsequently QQ were told to write them off...

 

i'd be looking at that route esp if you had other loand and a poor credit file at the time.

 

as for MMF

they are pretty much toothless since they got their wings clipped by the authorities.

 

they are NOT A BAILIFF

and as with ANY DCA ..they have no legal powers whatsoever.

I have not rseponded to any correspondence with them,

 

The last time i made payment was sometime last year and the loan is for £400.

 

well that is what i owe so i dont thing is one of those that was written off?

 

they have only recently taken it i think.

 

Must look at paperwork better a=ti get a better account to answer your questions.

 

They are asking to come up with a repayment plan.

Ignore their puerile demands for a repayment plan.

 

Their letters are simply generated and spat out by a computer, no human input less for the posty pushing it through your door.

 

Get all your ducks in order first, check your files, and statements.

 

If MMF have this, then something is wrong, but answer a few questions first please...

I took this loan back in December 2013 and repayed and borrowed more till I defaulted in 2014.

 

I was always dealing with QQ.

 

I then stopped hearing from them

 

till december 2016

 

which is when I got Motormile Finance's first email.

then IMHO id be starting an irresponsible lending complaint with QQ

I take it at the time you took this out

and at later time your credit fil had other defaults and late payments?

 

 

was this you only PDL you had

or you had other debts with other lenders?

If that's the case you can all but ignore MMF..

get that complaint going to QQ

lots of threads here already on QQ and irresponsible lending see the QQ forum

I just thought that maybe a CCA letter might put a stop to this? at least temporarily to start with?

 

No unfortunately, a CCA request isn't a silver bullet like the days of old.

 

Post 07 they learnt by their mistakes and made sure that CCA's were compliant.

 

As DX says, hit them with a IL complaint.

just looked at my noddle report and It says accounct closed £0. It appears 4 times as settled and this is that last entry:

 

Account start date 05/08/2014

Account end date 28/08/2014

Opening balance £ 300

Regular payment £ £ 323

Payment start date 05/08/2014

Repayment frequency Monthly

 

It is only since 2016 I have started getting emails about?

I have not in all honesty. I know I told them the right amount of earnings but in all honesty don't remember if they asked me for other loans or not in application. So maybe they can say I was dishonest myself ? I really wan to start it. Do you think I stand a chance?
