    • you've already got a CCJ   they said either pay the judgement CCJ sum and as long as this is within 28 days of the judgement date it wont then show [there is no fee] or fill out an N244 which has a fee of £255, but risk losing and paying the CCJ and your £255 fee + any court costs by the claimant in attending the set aside hearing if you lose.   so what did you do?
    • Hi the following may be useful. • Hi and Welcome to CAG     I have moved your thread to the appropriate forum as you refer to " Loan Repayments "...perhaps you could expand to get a response to your problem. You refer to s.140 is this  a regulated CCA1974 agreement ?   Andy
    • you cant claim both   dx
    • right slow down and follow the correct advice I've removed various links you have posted as they have obviously lead you up the wrong garden path to take since you started to sort this issue.   your story is extremely confusing because you have wrongly followed 1001 things that you shouldn't have done in the 1st place   by following that info to date you have confused things so badly that it very difficult to work out exactly what you have and haven't done to date.   I will summarise what I believe here has happened as its a lot simpler to sort your issue than what you have done to date however there might be questions yet to be answered BEFORE we can recommend what you should do next.   to me it looks like you have received a council Penalty charge notice [fine] AND  a speculative invoice CCJ and have confused the two?   I say this because newlyns are bailiffs and they dont get involved in private parking ticket matters. and the figure of £359.63 is NOT correct as it doesn't i bet correspond to the total of the sum claimed on the UKCPM claimform?   so you've not actually paid off the CCJ to newlyns but another council penalty charge notice not related at all to the CCJ this makes sense as your mention a second fine from UKCPM [which in not a fine]   please bear with us we need to see...   the original UKCPM windscreen ticket the notice to keeper from UKCPM. any letter from newlyn that you have.   scan these up to ONE MULTIPAGE PDF ONLY. read upload   as for the CCJ. im pretty sure you are getting the streets mixed up between the council pcn and the UKCPM speculative invoice one/CCJ   you haven't paid the CCJ within 28days therefore even if you pay it now it wont be removed   the only way to get the CCJ removed is to set it aside. however ..have you a copy of the claimform and the judgement CCJ? too

I've recently decided to try and get my credit history back on track.

I've requested my stat credit reports and notice that there is a CCJ on there from an old o2 account, which was obviously passed to Lowell and they have a default judgement against me.

I didn't know anything about this and I wasn't even aware the mobile phone contract with o2 was a 'credit agreement'.

I stopped being able to pay around March 2013, after my redundancy in 2012, when I just couldn't keep up the repayments.

I let o2 know about this and offered to pay them a nominal amount but didn't hear anything back.

The judgement was made in July 2014 and I moved address in July 2013 with 6 months address forwarding.

The strange thing is I had a Barclaycard CCJ come in May 2014

but this one to the new address and I wrote to the court and have agreed a payment plan on it,

so no idea why I didn't receive the o2/Lowell one.

Interestingly the o2/Lowell CCJ is only recorded on my Equifax report, nowhere else.

Is there anything I can do about this? Would I be able to get it set aside?

Thanks for any help!

did you inform o2 of your address change

and I doubt the BC one was BC that took you to court

but a DCA?

why did you not defend it?

I don't recall informing o2 of the address change as I had written to them informing them of my position and not heard anything back from March 2013 to early 2014 when the address forwarding would have run out.

Indeed, the BC one was IDR FINANCE UK II LIMITED / Link and I pay them £5 per month.

I had zero knowledge at the time about CCJs or anything debt related so didn't even realise I could put in a defence, didn't know how to go about doing it and was going through a rough time with my business at the time that didn't help.

god got fleeced by link

bet there was no enforceable agreement there never is on BC debts.

shame you didn't defend it, 9/10 you'd have won.

ok this Lowell one

you didn't inform the OC of a change of address

so I cant see a valid set aside

its there now for 6yrs paid or not

you cant remove it.

I do apologise, I've just been searching my scanned documents and have found the Lowell Claim form - I must've filed it and not responded!!! It was signed Bryan Carter as their solicitor.

Ah well, I will let it sit there as I've not heard anything since!

So annoyed I didn't tackle these properly when they came in but at least I've learnt a lot since then.

when ever you get a claimform no matter who its from

always defend all

else you'll get a ccj by default anyway

no harm in trying!!
