they cant pass the money over to the people who now own the debt as already pointed out, they cannot decide to give the money to a third party because the third party bought certain rights from them, not from you.

 

Bankfodder has explained this so you can actually issue a court claim for the mioney and as they have admitted they owe it then they cant really get out of handing it over in the way they suggest.

 

You should send them a lba and let them sweat for a fortnight. They know that they are wrong but think that you wont pres the big red button

I wonder if one got in and negotiated a quick full and final with the new debt owner, that would then exclude them from receiving the PPI settlement?

This is the misconception with statute barring.

Statute barring means the company you owe money to cannot use legal means to chase the money as they had 6 years to do it. The money is still owed after 6 years.

So you claim ppi from them. They can offset it against money you owe them.

 

Now the issue is the claims company.

You owe them the money you agreed to in the contract. You cannot dump your problems on them and expect them to waive the fees. Its not there problem you were in debt and defaulted.

I had the same issue with welcome and Ppi

 

My claim was through the FSCS and they offset it against the debt even though it was sold to PRA group

 

Complained to the FSCS about it and got a letter back explaining that they can off set as it was part of the agreement between welcome and the FSCS

when was the agreement taken out?

if its prior to 2005 then the fscs will not be involved

and their offset rules should not apply

which is why I asked the question in post 20
