    • Question: My wife received a couple of cheques (1 in Jan and 1 in Feb) from HSBC apologising how she was dealt with back in, yes, 2008. Now should we inform HSBC of our current address because they were forwarded from our previous one? The reason I ask is that redirect from Post Office expires in September.
    • not sure what you think is going on but they are nothing to do with any official court forms... it's merely a process and fleecing debt buyer must go thru should they be thinking of requesting northants bulk issue a speculative court claim on their behalf.   just send it as is dont change it.   as for d: just put .....the debt purchaser has yet to provide any or all of the required documentation.   dx    
    • if you type in auxillis is our search top right in the red banner you'll see this con over auxillis and supposed courtesy cars , but it's not its an HP agreement is well known here.   9/10 it's ends up with you fronting a court claim out of your own pocket for auxillis against the other parties insurance company that you don't stand a chance of ever winning for a claim against them for the excessive HP hire car costs you got scammed with.   may i be frank that whomever told you looking at the circumstances of you incident that you'd ever win a claim and it not be 50/50 was wrong.   you were in a narrow road in a housing estate with cars parked down one side on a blind sweeping bend exceeding the speed you should have been doing for the stated weather conditions. running into someone's side that pulls out infront of you in such an area and it being where you live too so you know it well would never be the other parties sole fault even without the poor weather. if this were to go to court IMHO you would lose.   sadly shows you were not p'haps driving with due care and attention. hence your ins companies stance.
    • I did see not to give those details out, but as these could wind up official court forms, I dont want to be on the wrong side of it.   the areas in boxes D and I, is it ok to say ""refer to appendix A, refer to appendix B"? There s a REALLy long list of "what the hell" I want out of them as this is making zero sense. Not only that, I've got a long list of "this is the hell" I need to send back in the dispute too.

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
      I opted for mediation, and it played out very similarly to other people's experiences.
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

Claiming as single for tax credits when I am living with someone

I have made a horrible mistake in not informing tax credits that I resumed a relationship with my partner in early 2015 and started living together. I had every intention of doing so but I became dependent on the money I was receiving and it's become harder and harder to admit to them

What I've been doing!


I have recieved letter asking whether I am living with mr .... (my partner) and to send documents such a bank statements, mortgage statement, car insurance, council tax. My husband is on my council tax as I always intended to tell them he was living with me again. He is also a named driver on my insurance. They want information and docs dating between 1st Nov 16 to 31st Jan 2017. Do I just send them Ono for those dates and see what they say? Or should I come clean about everything straight away. I have already updated my status online yesterday as I wanted to make sure I stopped receiving anymore payments. But instead of giving the actual date he moved in I said he moved in 6th Jan 17. I am now regretting this as I think I've made things worse.


I am terrified that I will be sent to prison for fraud and that I will give birth in prison (i am due 1st may) I also have a 2 year old and a 15 year old.


Please tell me what to do. I can't sleep eat and I have been physically vomiting all day!!

I have also not told my husband. He doesn't know I've been making a single claim. He believes iv been making a claim as a joint couple. We don't have a joint bank account so he was never aware of what I was receiving.


I know there is no excuse for what I have done and I am deeply ashamed of myself.


I know I should just own up to everything but I am worried I will turn this from a civil matter into a criminal one!! I am worried sick!! Don't know what to do??

Calm down... unless you have been in trouble before prison is unlikely.


It sounds to me as if this is being treated as a compliance matter.


How much were you getting a week?

It hasn't been this much the whole time we have been living together as I was maternity leave for some of it. So wasn't claiming child care until I went back to work until oct 2015

Call them and explain that you have made a gross error of judgement.

Tell them straight away that you're pregnant and not thinking right and offer to repay what's due.

In other words come clean otherwise they'll come down on you like a ton of bricks.

Don't worry about prison, it won't happen.

Also tell your husband because they'll be some cuts in the family budget and he must know.

I've been ringing the number on the letter for most of the day but no one answers it . I am thinking of going to the CAB tomorrow for advice. I read somewhere that they have different numbers to what we are given and are more likely to get through. .

Hello there.


It's possible that people who've been there as well will spot your thread, but often they seem to take our advice, see a good resolution more often than not and then they don't reappear.


Have a read around this forum for tax credit threads, especially when they're marked as resolved or something similar. Very often, people are surprised about how understanding tax credits are.

I got through to the tax credits just now and they were brilliant. I told them everything and they said they wouldn't look back over any of the years just the period they were looking at 1st Nov 16 to 31st Jan 17. They ended the joint claim and said to apply as a couple. I will have to pay back the overpayment for this time. Thank you everyone for your replies and advice. I'm so relieved. To anyone going through the same thing. Just call and be up fronts you feel

So much better for it.
