I have returned home to receive PCN from this outfit.

 

 

The notice has a photo of my vehicle entering and leaving a car park in Torquay on 23 January

 

The reason for issue was 'parking session expired or unpaid.

 

I do not dispute using the car park.

 

I fear that as this car park relies on users punching their car registration number into the machine that I may be guilty of punching in wrong number.

 

I no longer have the ticket that I paid for so if my fear is realised I do not have the proverbial leg to stand on.

 

Any advice on how I should set out an appeal.

 

Should PPS make reason for PCN clearer

if there stupid ANPR system is not linked by time to their useless machines

that's their problem

but you do NOT ignore it

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Searching for ticket but not hopeful. Car park was almost empty at time of visiting. If the incorrect reg no was entered I am sure they will easily be able to determine the actual number put in at the time I entered car park

it will be easy for them to determine the reg number you entered as they wont have a matching ANPR image for that car.

 

 

However, they arent going to supply you with that information becasue then they wont have a reason to rob you blind.

 

Now, there appears to be a kiosk at the entrance so is this how you pay to park at certain times or is the google image outdated?

 

Post up the NTK with your personal details redacted so we can see the wording of the letter.

It is unlikley that it is good enough to create a keeper liability but even though that should be enough

 

 

many judges dont know the law so we dont want to say that things will be fine and you get taken to court and lose becaseu some DDJ hasnt bothered to read his case notes.

However, the NTK fails to contain certain informatio to make it POFA compliant so no keeper liability has been formed.

 

What to do? sit on it until they write again and then tell them that there is no keeper liability in this matter as their letter isnt POFA compliant to create one. Demand they pay you £250 for the breach of the DPA regarding them using false representations to obtain your keeper details form the DVLA as per VCS v Philip (Liverpool, dec 2016)

 

Let them spend their money chasing you first though. we dont want to give them the opportunity to correct their mistakes.
