Sent off my SAR today finally (been concentrating on my other claims)

 

Claiming for charges from around 1996 - 1999

 

Going to be estimating as I've already been into branch and they have no records as they say they have been deleted. In my SAR I have asked for evidence of how and when the data was destroyed.

 

Question for anyone that has estimated.. how can they disprove it I mean if I say these ARE the charges rather than estimating... you know if Isuddenly found my statements lol

Fees from July 1998 - May 1999 were £25

Feeds from June 1999 - Sept 2002 were £27.50

 

Anyone got the figures from before that from their old statements?

hi,

1996 excess overdraft sometimes £10.00 sometimes £17.00. recall charge £15.00 / £25.00.

1999 card missuse £10.00 / £25.00, unorthorised overdraft £25.00, total charges ££25.00 / £27.50,

2000 recall charge£10.00 / £28.00

what's card misuse? I've had DD bounce and have cheques go in that were garanteed but funds weren't in in time.

 

what dates were excees overdraft £10 and what date £17?

can anyone also help with when the charges were applied to the account in the month - where they as they happened or a set date each month?

Got a reply to my SAR - saying:

 

"Unfortunately, HSBC only holds this information in the format of bank statements for a period of six years. Our records have indicated that your account was closed was closed over six years ago. As a result we are unable to supply you with the information you have requested"

 

Now two key points:

 

A) I specifically asked if data not availble how and when was it destroyed (no answer to)

 

B) they only say they only hold statemetns for 6 years and doesn't say they don't hold it in another form.... (microfinche?)

 

What do I do now?

I had similar reply, told me it was closed in 1999!

If they know it was closed in 1999, they have some sort of info on it.

My LBA will say something to that affect, along with I don't mind micofinche or whatever.

Then again I might just send my estimated claim in, that'll frighten them!

thanks - can anyone help with the specific costs of charges for the period April 96 - July 98.

 

I believe Jul98 - Dec98 the charges were £25

 

I know they were £20 before that point but not sure how far back. Can anyone help from their old statements, I want to get the values right at least? Many thanks

how are you going to do your breakdown of charges with an estimated figure - if it goes to mcol stage, surely they are going to want to see hard evidence??

I've estimated my breakdown. This is my "personal record" if asked.

 

I'm more than happy for HSBC to show me my statements to prove otherwise :D

FWIW

 

You cannot realistically estimate a claim if you have no data to go on.

 

If they say they have destroyed your statements you need to write back and re state that you want data not statements.

 

Ask them how they destroyed your data gain, when they don't provide it, take them t court for non compliance.

 

And they dont have to disporve your claim, the burdon of proof is on the claimant, always!

What records do you have? If say you had accounts you had prepared and jkept for the required period yourself in written form or computer records then that would be fine.

Stalled on this one at the moment - can't get any statements - I wrote a pre-lim and LBA estimating the charges hoping to get a goodwill gesture as I can't really proceed with a court claim as I don't have proof of the charges but htey wrote back saying they won't pay as it's over 6years old.

 

I'm going to try and check out Metroplotion Collection Services - whom my overdraft was passed to years ago, they may have records from HSBC on me. Worth a go.

 

Any advice? Anything I can do to be able to move forward with this claim?
