Hi,

my husband had motor bike insurance he took it out 12/08/16 monthly instalments

they emailed him for cbt number

we were away at time didn't see emails,

 

got email 25th to say insurance will be cancelled 31St

they are charging us 75 pounds

 

I'm saying to devitt that they knew it was being cancelled before 14 days cooling off period.

as we didn't see email he was riding around till end of September on the bike only way we knew he wasn't insured was we found a card from post office saying something couldn't be delivered

 

took it to post office received letter.

 

Can we go down the cancellation known before 14th day route?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi

 

 

On the 12/08/16 my husband took out motorbike insurance with Devitt

they say 12/08 a letter was sent asking for CBT number within the next seven days

 

 

we didn't receive this

they say a second letter was sent and then finally a third letter was sent 25/08

 

 

they sent recorded delivery letter saying cancelling insurance 31/08

we didn't get that letter till 14/09

so hubby driving without insurance any way

 

 

the amount they say we owe is £95 - £115 debt collector says we owe.

 

 

If insurance was cancelled within 14 day cooling off period then the amount of £30 would be Ok!

 

 

what I feel is that letter from the 25th intention to cancel was the 25th within the 14 days what day they choose to action it I feel is unfair as then that goes up to £95.00

 

 

if we have to pay we will pay

 

 

just wanted to ask really if we had anywhere to go with this.

and if this amount has to be paid

 

 

do I pay the £95 or the £115 that Debt collectors say we owe?

IF you really owe £95 for 1 months insurance then that is what you owe.

 

 

NO dca can add more to that debt

 

 

but they all like to think that you dont know this and add something to make it worth their while to write to you.

 

Calculate the exact portion of the year's premium is due for the time that he was insured and send that to Devitts.

 

 

If they dont accept it then they are owed nothing under rules of mitigation.

 

Ignore the dca completely

You have few issues here.

 

1) how clear was it that the CBT info needed to be sent in quickly to Devitt ? Suggest you look at the info when the policy was bought.

 

2) if it was clear that the CBT needed to be sent and that if not received the policy would be cancelled incurring a cancellation admin fee of £75 plus time on risk premiums being due, then you should settle the £95. But you can request a full breakdown of this amount and that it does cover Devitts costs. If Devitt supply the info, then you can pay Devitt £95.

 

Up to you to look at what info was supplied when buying the Insurance and to make a written complaint to Devitt. If you cause them enough hassle, they may write off the £75 admin fee. Insurers quite often just write off these fees, rather than spend too much time and money dealing with complaints.
