Please help - county court claim from VCS/BW Legal re Aldi car park

Hello please can you help, I am been taken to county court for alleged parking in a restricted area in a private car park, I am unaware that I have committed any parking contravention, I received a parking charge notice from vehicle control services through the post stating I was parked in a restricted area of the car park, there was no photo evidence with this ticket.

 

The parking charge notice states that I drove away before the patrol officer could attach the ticket to the vehicle, but yet on the ticket, it states period of parking 11.29am to 11.42am would this not be enough time for the officer to attach a ticket, and also I could not have driven away as I was still shopping in Aldi at 11.49am, which I have a receipt from Aldi to proof this.

 

Basically what I am asking is will the incorrect time on the parking charge ticket and no photographic evidence be enough evidence to produce in county court. I have already submitted this evidence to the county court but the claimant bw legal, specialist in legal recoveries is stating that their client still intends to continue with the claim against me for the sum of £241.80.

 

I have just received Notice of Proposed Allocation to the Small Claims Track.

 

Any help would be much appreciated.

then you need to gather your evidence together as you have already submitted some sort of defence. If you ahd come here at the outset we could ahve drafted a letter that would have knocked this on the head at an earlier stage. We need to know what points you put in your defence. We also ned to know what it is they are claiming the money is owed for. the wording of this is crucial so either scan up the POC from the original N1 form or write it our and not your interpretation of it.

We need details of the dates and place of the event, what paperwork you did receive from them, what exactly you said in response etc. The vagueness of the origianl post tells us next to nothing, we need every detail as that is where your defeat of this silly claim lies.
