i) what locus standii does the named defendant have to act for as Northampton Autosports if they are also claiming they shouldn't have been named as a defendant?

ii) Any such appeal will be opposed, not least on the grounds that it was not sought 'promptly'."

 

Let him stew in the legal identity knot he tied.

 

Or, ignore, until he actually issues a claim or files an appeal.

This forum has a way of allowing worriers to sleep at night :)

 

If possible, I really don't want to return the vehicle. I've had to spend a lot of money getting it roadworthy so I could use it as I didn't have the money to replace it. The car sat idle for 8 months while it was going through the initial CCJ. Once I believed I wasn't going to get my money I decided to repair it.

 

I'm going to make a few phone calls tomorrow, but I'll definitely be taking your advice on board.

well if dipstick wants his motor back

he's gotta pay for all the repairs too.

 

he'd do that to you if the boot was on the other foot!!!

 

and ofcourse CRA states that he must recompense you too.

so shooting himself in the foot by quoting that

what was it 3 times!!

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

You could point out that there is no company called the Performance Trade Autocentre.

 

And that all companies are required under the Companies Act 2006 to disclose their full registered name, company number and registered address on all letters!

 

And ask him to confirm if you are being contacted by a company, or by [name of individual] personally?

Thank you very very much for posting this thread.

Unfortunately I too have fallen foul of this 'character' despite my Googling the business name in advance to try to avoid a similar situation to the one you found yourself in.

 

If you read this anytime soon, would you get in touch please.

I only need you to point me in the right direction and maybe share some contact details for key entities I need to use to get my money back.

Well I see that this story hasn't been updated since 2017.

Any chance of finding out eventually what happened and did you have to return the vehicle?

For future reference, in a situation like this if you do have to return the vehicle then it would have to be subject to some reasonable settlement in respect of any improvements and although I can imagine that the dealer wouldn't want to do this voluntarily, this is probably what a court would order if the court considered that the dealer had brought the problem upon himself.
