Hi,

 

Ive just started with my prelim letter to Natwest. Im owed around £3400 in charges over the last 5 years. I have decided to use the contract interest rate which brings the total up to just under 5k.

 

Just waiting for the first bugger off letter to arrive on the door mat.

I'll try and keep this thread updated for peoples interest. Wish me luck....

Cheers guys, will do. Its quite liberating to be doing this after around 5 years of financial missery, taking out loans to pay others off etc. The banks and CC's take liberties with people who are not as financial savy as perhaps they should be. Definately needs to be something they teach to kids at school IMHO

Recieved the standard bog off letter that most people seem to get from Stuart Higley. He must be a very busy person!

 

So im just getting ready with the LBA. Just wondering if I should wait the full 14 days before sending it or as I have had a response just send it now?

Hi there Bob,

I think Mr Higely is actually a robot and generates this standard BOGOFF letters at a touch of a button:lol:

As far as the LBA goes, I too got a lame response to my prelim letter and after following the correct procedures, I've just filed my claim with the court. The general census is that responding sooner or after the 14 day period is a personnal choice, it doesn't seem to afftect your claim in the long run. The fact that you've given them adequate time to respond and they have, be it all rubbish, appears to be enough.

Thanks very much for the info Bob (sorry, found out someone called Meister has responded to my thread which went to my hotmail account...automatically pressumed it was Bob.....was abit confused), but I'm afraid I've already surpassed the LBA stage:)!!!!

I've just filed a claim with Bournemouth cc and am currently waiting on Natwests' response.

The Borehamwood address is where I to sent my LBA and got a very brief FOB-U-OFF letter, once again from the infamous Mr Higley, it was then time ti proceed with the next stage. Who knows they might decided to cut their losses and actually refund your moniesnow, rather than wait for you to take them to court, but unfortunately, it's highly unlikely..we live in hope.

I went to the court on the 5th and handed in My N1 with POC and list of charges being claimed. Was issued on the 11th March.

 

Ive just recieved cobbetts defence. I guess its standerd except that they have ..

 

" invited the court to direct that there be a case management conference in order for the court to consider the making of appropriate orders to give the claiment the opportunity to properly particularise the claim "

 

I dont appear to have to complete the Cpr part 18.

 

What are my next steps now? Do I just wait for the courts?

Seems like a fairly standard cobbetts response. Unless the court has ordered you to do so i believe you do not need to respond but i would ask the master of court stuff Michael Browne for an opinion.

Hi there, Im at exactly same stage as you, just waiting for the defence from court. Ive had my copy from Cobbetts on Sat 7th April, and like you, they didnt ask for CPR 18 from either, so Im just waiting now for copy of defence with directions from court. I know I dont have to furnish them with any further info, but purely out of courtesy, I sent them another copy of my charges spreadsheet today, because their standard defence basically said, not particularised claim properly, when clearly I had, I had used the one from here for MCOL, word for word, and I have already sent a copy of my charges to them by recorded and to courts, so theyre just playing silly beggars, but Im not now going to do another thing until I hear from court with the defence. I will keep checking on your thread to see where you are up to, because it sounds like were at exactly same stage. All the best.

Just recieved their AQ and they are requesting it go in fast track unlike me who wanted it in small claims. Claim is for £4900 + court charges. They have put the total on the form as £5019 - which pushes it out of small claims court even though its the court fees that put it over the 5K.

 

Just have to wait and see what the judge decides I guess. Does anyone know how long it takes to get allocated normally at the Reading court?

It does seem like that Bob. But its all tactics to wear us down so that we throw in the towel. That isn't going to happen. So patience is your best friend on this site sometimes.Good luck.
