Medical Negligence Claim, Falsifying and lost Records??

For over 5 years Myself and my Son have attempted to bring a case together for Medical Negligence against an Hospital in Sheffield from the time frame of 1996 -2010 where my son suffered terribly and was in critical conditions on 3 occasions.

 

We appointed a solicitor back in 2011 to deal with this matter, In 2016 this firm of Solicitors went in to Administration, and we were passed on to another firm to carry on our case.

 

It is a very complex case we as there are many issues dating from 1996-2010 with 3 Hospital stays.

 

We have recently received a letter from this new firm of Solicitors stating that they are closing this case due to lack of evidence etc.

 

It is evident that there is falsifications in my Son’s Medical records and apparent lost information.

 

I have contacted my solicitor pointing these issues out, and explaining that we have solid proof that the information from my Son’s Medical records are false. We are waiting for a reply from them at present.

 

 

We are unsure of what route to take with all of this, and we would greatly appreciate and advice or support anyone could offer. :|

What "solid proof" do you have?

 

How old is your son?

 

You could search around for a new firm of solicitors that specialist in medical negligence claims if your current solicitors don't want the case.

Hi,

 

We have witnesses, Photos and Video evidence. My son is 20yrs old now..

 

I have contacted a few Solicitors today, But we are unsure at the moment if they will be prepared to take his case on, as the deadline to bring them to court is only a few months away now, due to the delay in medical records in the last 6years.

Sorry I am quite new to this site. and quite stressed with it all.

 

The Hospital have stated that my son was discharged from their care in September, when it was infact it was the middle of October.

They also state that my Son had 2 operations, when he had 9 in a month.

 

There are so many missing details from his care on all 3 occasions he stayed in Hospital.

So where does the faking paperwork come in?

Because the Solicitors have 'Copies' of Medical records stating the dates he was discharged from their care, this is false as we have proof of the dates of discharge.

 

Also copies of apparent surgical procedures he as had.. Which to my knowledge never happened.

 

Without going into all the details.. as its so complex! Basically the GP failed to to admit my Son into Hospital after 6 appointments in a week, vomiting blood, and passing blood threw stools, This was passed off as a virus. (These records are missing)

 

From there my son had a major surgical problem and had septic shock, he was give an hour to live.. but doctors reduced the dose of drugs and he pulled threw (I had a consultation with the doctors afterwards, and it was stated that my son had been overdosed) Little evidence in the records over this.

 

Long term ventilation caused narrowing of his airways. Several years later my son was back in Hospital and was ventilated again.. Doctors put the adult sized tube in his throat unaware that he had narrowing of his airways, This scarred his airways even more and dislodged part of his vocal cord. (Missing records)

 

In between this my Son had a broviac line in his heart, this was not maintained for 8hours - Resulting in a blood clot in his heart ( These records were not sent to my Solicitor)

 

The main incident was when he was back in Hospital again - On return from an operation he was given a yogurt and a drink, he developed E-coli from an out of date yogurt. Rushed back to ICU and he was in a critical condition. Dr's failed to change a dressing and it leaked on the bed.. On changing the bed sheets my Sons head fell to the side and cut off supply to his main artery in his neck, He had a cardiac arrest and he was then in a life or death situation. (Records altered in this matter also, as the time frame does not add up).

 

Hope it makes a bit more sense now.

I am so sorry to hear about what happened. That sounds horrific.

 

If the new firm of solicitors does not want the case, is there any reason why you cannot engage ask for a copy of your file and engage a different firm? Preferably a firm that has plenty of specific experience dealing with medical negligence claims?

 

Correct me if I am wrong but it sounds like your current firm may have been engaged under a 'conditional fee arrangement', so you should take a quick look at your engagement letter before disinstructing them to check you are not inadvertently making yourself liable for their legal fees.

I will attempt to get a copy of this file from my Solicitors, and like you say try and engage a different firm.

 

I will also have a good luck at my agreement, all the last letter said from them was that it was a no win no fee (the costs of this ongoing matter resulted in over 29k on the last statement)

 

I was originally with another firm up until early this year, But this company went into administration and passed my Sons file on to this new firm to carry on.

 

Its all confusing, and my head is mashed with 'Googling' everything.

If you change solicitor you'll be liable for the 29k, so that's not an option.

What you could do is ask for a meeting with the solicitor and ask all the questions you have.

If you're not happy about your solicitor you could ask for the file to be passed to another solicitor in the firm.

To do this you will need to be very tactful and politically correct.

If you start saying that your solicitor is a mug, it won't get you anywhere.
