Are private parking charges now enforceable ?..

 

I am trying to help someone sort out a parking issue and this company called ZZPS claims that a parking charge issued on private land is enforceable and does not breach the unfair terms in consumer contract regulations 1999. Any advice would be appreciated..

They are still speculative invoices but you should not ignore in most cases

It would be far better if your friend posted himself as getting information third hand is an absolute nightmare. Pulling teeth is far easier.

I do understand what your saying but she is not in a good place at the moment and is vulnerable in my opinion so some one else just needs to often support. Once I get the clear information off her I shall just get on with it..

Have a read around the forums, CD, or ask your friend to.

 

Penalty charge notice is from the police or the council, parking charge notice is from a private parking company [PPC].

Thank you, that's what I thought, this is a parking charge notice with the local authority logo on it but contracted out to a company acting on behalf of the council..

ZZPS are just a dca that are entirely owned by one of the parking co's so have no powers to do or claim anything. They are just rentathreat windbags and can be ingored until the cows come hme.

However, someone paid them to send out bits of a dead tree so tell us about the original event and we can advise.

A/ Client is National car parks Ltd.

 

B/ location, North Greenwich station.

 

C/ Unauthorised long stay.

 

D/ Parking charge notice.

 

Thank you, that's what I thought, this is a parking charge notice with the local authority logo on it but contracted out to a company acting on behalf of the council..

 

I made a mistake by saying the local authority logo was displayed, I was looking at a different ticket. This issue is as previous text.

I like the word unauthorised as this implies that trespass is involved. this loses NCP any court claim as tey would then have no locus standi.

if this pcn uses the word unauthorised

it means someone has to authorise you being there

 

so if they are not authorising you being there because your ticket had expired

...then the only law you might have broken is one of trespass

..so they own the land...bet not!

was she attending an event at the o2 or just parking there because she uses it for work?

 

were not simply asking these questions In post 2 to make us feel better or important...

this is all about contract law and nothing really to do with the parking itself,

it could be any act or agreement that is the focus of this.

 

having said that we need to knwo the details of the event and the nature of the contract that has supposedly been made and breached.

 

as you have gathered, my point about a claim for something that is unauthorised means that it is not a contractual matter but trespass and that means only the landowner can make a claim and they have to show exactly what loss or damages has resulted from that trespass.

 

If NCP owned the land then they could sue and claim for the loss of income they otherwise would have got from that parking space if your friend hadnt trespassed, which will be about £2.

 

As NCP probably dont own the land they cant sue for trespass.

seeing the original paperwork will allow us to see what else thy may well have got wrong in their procedures as they have to follow the protocols of the POFA to create a keeper liability.

 

Without that they arent allowed to access the DVLA database and they certainly have no claim against the keeper of the vehicle.
