So, could you have defended the claim back in june 14 when it was registered?

 

If so, what would your defence have been?

 

We are trying to establish if its worth attempting to set aside, if you have no valid defence against the claim then its a pointless exercise setting aside.

 

When did you take the cc out with HSBC? Pre april 2007 or post april 2007?

The reason I could not make any payments was that I was unemployed at that time.

If I had been made aware of the fact that Hoist were filing a CCJ,

 

I could have borrowed from friends and relatives as a last resort to avoid that happening.

It would at the very least have made me aware of the seriousness of the situation.

The actual credit card was taken out in november 2004.

Should I make a request for the actual credit card agreement? Or is it too late for that?

Ok so prior to the issuing of the claimform,

which went to your old address probably soon after you moved,

 

 

did you receive a default notice or annual statements,

if they havent followed the correct pre action protocol you could have grounds to set aside And defend.

 

See what the other team members think first tho because it will cost £255 to apply to set it aside unless you qualify for fee remission.

I dont recall if they had issued a default notice or annual statements. :-/

 

Is there a way for me to find out whether they did?

 

ALso, if I pay off the CCJ now, will it send a signal to other creditors to come calling?

Update: I've paid off the CCJ with Rosbinsons/Hoist, and am now awaiting the certificate from the court. Robinsons have sent me a letter stating that the debt has been settled. Just a heads up to anyone else who may be in a similar situation: it takes ONE MONTH for the courts to issue this certificate. :-/

As long as you are aware that despite being paid and having a certificate of satisfaction, the ccj will still remain on your credit file for 6yrs from the date of judgement

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
