Hello all,

 

I received today a letter from "marston High Court Enforcement Officers" :

 

 

Strange thing is that I have NEVER received any letter, information or anything prior to above notice.

..but the stranger thing is that I NEVER drove a vehicle without a valid licence

- besides on the date of this incident (13/06/2016) I was home off sick,

after being hospitalised for 4 days (doctor gave me a sick note for 2 weeks)

- I was unable to drive during this time due to heavy dosage of antybiotics & painkilles

and the fact that my left foot was so swollen that I was almost unable to walk more then few steps

(I had Cellulitis - which is an infection of the deeper layers of skin and the underlying tissue.).

 

I think that this is happening because somebody either with the same name did that offence

(and in some twisted way it ended up with me)

or someone deliberately gave my personal information to avoid being fined for this

...in any case what are my options?

How should I proceed with this case?

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

do you hold a driving licence?

 

 

I will guess that a statutory declaration is the answer to this?

You do have a license? Is the name exactly the same as the alleged offender? Marstons may have done and relied on a faulty trace as in two Mr Joneses, and picked you. As DX mentioned, a Statutory Declaration in the Magistrates Court that you are not the offender is an option, but the clock is ticking you have I think 21 days after learning about the conviction to challenge, other Caggers will know more

It is possible that the enforcement company (or even the Fines Officer at the court) has undertaken 'tracing' on your account and identified you as the person responsible.

 

I have been posting on here for almost 10 years and readily admit to having an obsession with accurate advice (hence my cautious note about it being 'possible' that your details have been identified via 'tracing'). Where I do have a problem though is with the DATE of the incident (13th June). It is not usual for new fines to undertake 'tracing'. This is usually for fines that have previously been with bailiffs and returned as 'gone away' etc.

 

Also, the 'incident' date may be incorrect and this date may well be the date when the court made the order.

 

To way to resolve this is quite simple:

 

You need to visit the DVLA website. There is a section there where you can 'view' your driving licence. You will need to have your driving licence to hand as you will need the reference number from your licence. You will then be able to see details of any fine...which court dealt with case....and how many points etc and the level of fine handed down.

 

Please post back once you have the information. We can then assist.

 

PS: Have you checked your V5c to ensure that it has your current address. Have you moved recently?

I just checked my licence on DVLA website - 0 points and no fines

I live on my current address for 2y now - my driving licence and V5c both have my current address.

 

I have my licence for 20y - never had any points on it, never got any ticket - have been stopped by Police only 2 times and it was for a routine check (driver licence, V5c, insurance documents), last time was over 11y ago and I had all my documents in order (as I alway have)...
