    • Perfect, thanks Dave.   You're right, a whole dodo storm this has been. As sons of first-generation immigrant parents, whenever something like this happens the old man panics. There was a whole "appeal this now" because my dad paid for the parking as he was with the hirer at the time and he isn't as tech-savvy as my brother so he ended up doing what he did and because I don't live there anymore it came all the way down to this.  But yes, we'll do this SAR and see what comes of it.  Will keep posting here with the hopes that it may benefit someone in the future.  Thanks again, everyone.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

How do you feel the panel reporting how much power it has generated adversely affects you?

What is your concern: the mobile phone signal?

Or the data being sent? (Which relates to the power generated, not anything personal to you!)

The information it would send back would be the same if you were in the property for 2 weeks, or away on holiday for those 2 weeks, namely how much power the panels generated.

So, how does it adversely affect you, or make you "under investigation"?

How the hell does it not, potentially!

 

X amount of power (generated as a result of Y amount of sunshine).

That gets reported regardless of if it is you in the property, someone else in the property, or you as the tenant but away on holiday.

 

How does it adversely affect you? Or "investigate you"?.

 

You should have more concern (and even then it should be "not concerned much"!) about the electricity meter keeping a track on how much electricity you are using : that at least is dependant on you, rather than merely on how much sunshine there has been!.

Hi

 

The wireless information that would be sent using the device would only contain information about the energy and possibly information on the system to the provider.

 

As this is the Landlords property they can install these panels without needing your consent as it's the Landlords Property.

 

Now I can see your point that the installation of these panels would affect you.

 

As the Landlord would need to notify you of the works as they will need access to the property at some stage and the dates they would need access.

Just to add my 2p

Having solar panels should save you money. Unless the landlord charges you for the electricity you use then you will get cheaper bills.

 

As this is a 'rent a roof' scheme, the landlord will make nothing by having this done as Voltaire will get the FiT (Feed in Tariff) for any excess electricity generated surplus to your needs.

 

The access that will be needed is to your loft but that can be done from the outside if there are tiles (rather than slate). The panels will have a cable to will go to somewhere near the meter where there will be a box that is attached to your meter. The SIM card is very similar to a smart meter and sends data to Voltaire and possibly the electricity supplier so yes, they will need access to your home but the works will be minimal.

It's also good to mention that photo-voltaic panels have improved over the last few years and are more effective than previous years.

 

In a nutshell, it will send data of your usage but you should benefit from cheaper bills plus the simple fact it is the landlords house and he can do what he likes and he has notified you of the works so his responsibility to you is done.
