    • Thanks Dave It's not too far away, about 8 or 9 miles, I will probably venture over on my bike if I can't think of a good reason to drive there again! I'll have a chat with Mrs GB_Joe tomorrow and see which shops they visited, I know M&S was on the list (had to try on multiple sets of trousers!) and they are actually in that bit of retail park. The uniform shop is across the way in the Meridian Centre, so probably not helpful to get them involved.
    • As they have failed to deliver their original PCN you will need to send them an SAR where they should provide that PCN. It should show the address they used . If it is not your current one that would explain the non delivery. If it was correct then perhaps the Post office messed up. A more cynical view would be that UKPC didn't send it so that you couldn't claim the reduction. It appears that UKPC have been there for some time  but I have been unable to find any pictures of their Notices.The leisure park itself is pretty big so while some parts maybe give 5 hours free parking other parts may have restrictions like permits. I haven't been there for years -I went  to Nandos and the bowling centre . I am surprised that they are now infested with UKPC as the place is plenty big enough not to require their dubious services. If you live not to far away it would help if you could get some legible pictures of their signs. Be carful to park in an area that doesn't require a permit and take photos of the entrance signs, the five hour sign and the permit only sign as well as any other signs that are different from the previous signs. Also if their is a payment machine could you please photograph that.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I feel we are just going round in circles with this debate, and you have your entrenched viewpoint, which I respect.  It is your view.  I just disagree on some points because, to reiterate, Labour still won as many votes as Blair did in 2002.  The Brexit situation split the vote, and I don't personally understand why you can't take on board that this election was unique as a lot of Labour voters turned to the Tories because of Brexit.  I also don't understand how anyone can not see the role of the media in setting the anti Corbyn narrative.  It is a fact that people largely get their information from news sources, and it is also a fact that the media representation was majorly anti Corbyn, or at least leaning against Labour.  I don't see how someone can't see the correlation between a wholly negative media campaign and the notion that Corbyn would be very very "bad" for the country.

 

Ask a lot of people why he would have been bad for the country and you get some vague BS about taking us back to the 1970's (Something suggested by Tory politicians and media outlets), or some nonsense about "bankrupting the country" (Again, merely repeating what some Tory politicians and media outlets have told them, without being able to coherently describe why their economic strategy would ruin us all)

 

Your viewpoint seems to be that he's after power.  I would argue that a man who has spent 40 years on the backbenches arguing against the policies of even his own party suggests otherwise.  Unfortunately Corbyn has had to come to the realisation that when you get to the top in the current power vacuum, principles largely have to go out the window, and your opponents will come after you like never before.  Take the media campaign about Corbyn being a terrorist as an example - 40 years an MP with access to sensitive material, yet no doubts were raised until AFTER he becomes a real threat.

 

I think even Blair would have lost this election, especially given Iraq severely blighted his premiership.

 

You're also under the illusion that I am some sort of Corbyn fan boy.  I'm not.  I support the truth, and take a reasoned viewpoint on any situation.  I had never voted Labour prior to 2015.

Sorry to reappear after a long pause.

I just wanted to say: "I TOLD YOU!".

Brexit has happened as I predicted and despite all the effort in stopping it.

Now for the next 2 predictions:

1. In 5 years time our economy would've grown faster than any other European country. 

2. In 15 years time the EU in its present form will cease to exist.

Tobyjugg2, unfortunately most of my posts are censored,  so i can't reply and will go away again as clearly i'm not welcome on this forum.

You seem to talk down to everyone by using cut and paste rubbish and trying to show tha above us all.

What you should look at is FACTS.

First of all is the fact that you were convinced brexit would be stopped, i said it will go ahead.

In case you don't know, Brexit happened, exactly as I told you.

You were wrong but insist in saying that you are right.

I made my 2 predictions and from your answers it is clear that you haven't got a clue about basic economic and financial matters.

I hope you see this post before is censored. 

My advice to you is to anchor your feet to the ground and look out of your window, good luck with your delusion.
