    • Yep, true to form, they are happy to just save a couple of quid... They invariably lose in court, so to them, that's a win. 😅
    • Your concern regarding the 14 days delivery is a common one. Not been on the forum that long, but I don't think the following thought has ever been challenged. My view is that they should have proof of when it was posted, not when they "issued", or printed it. Of course, they would never show any proof of postage, unless it went to court. Private parking companies are simply after money, and will just keep sending ever more threatening letters to intimidate you into paying up. It's not been mentioned yet, but DO NOT APPEAL! You could inadvertently give up useful legal protection and they will refuse any appeal, because they're just after the cash...
    • The sign says "Parking conditions apply 24/7". Mind you, that's after a huge wall of text. The whole thing is massively confusing.  Goodness knows what you're meant to do if you spend only a fiver in Iceland or you stay a few minutes over the hour there.
    • Hi and thanks It looks like they ticked all the boxes to me but I'll try and upload the notice. I was wondering if a witness to late delivery might be considered proof - I'm assuming they posted it as normal but Royal Mail stuffed up delivery. If not then they're really saying it just has to be posted within 12 days of the incident, regardless of when it is received. Annoying! edit ok thanks Honeybee here's my 2nd (actually 3rd) attempt at anonymising, copying and uploading the notice! Sorry about the state of it - I sat on it while distracted by my dog 🙃 pcn front.pdf pcn back page.pdf
    • ROFL - dont get upset just because someone (quite a lot of someones) dont want smart meters - well unless you get paid for it .. in which case ...   I assume you haven't been with Octopus long enough to be on one of the very long fixed price tariffs they offered before the prices went bonkers .. and that you dont use your electricity in the evening/lunch time if you think the 'agile type tariffs are good value .. let alone worth installing a smart meter for - high price a good disincentive for an evening cuppa eh? Let alone all your computer/tv etc time in the peak price evening or lunch time. - and boy do those peak prices instantly hammer your bill when those Russian and middle eastern issues kick off.   I would only have considered a smart meter if solar panels had been an option for me - but roof is oriented completely the wrong way. Oh - and My opinion hasn't changed since the smart meter trials 40 years ago, because neither have the issues (well not enough) but I'm happy for you. Be happy for me.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Even then there are still key issues with the EU that will need addressing.

This is the little sticking point that doesn't seem to change. Mr C tried all this. Forty years should be pretty much perfect, but it's not and that's why the vote swayed to out.

i had thought the vote 'swayed to out' mainly simply re the false immigration/nhs/sovereignty claims? rather than any serious thought re the whole eu system itself.

though yes, maybe more pressure shld have been put on the eu to reconsider its mandate.

In addition to Fords very salient point, Mr C GOT a deal for the City of Londons International bankers in the 'EU renegotiation' he succeded at what HE was after -

pity he didnt address the issues that concerned the British public.

But I do agree its long past time OUR UK politicians addressed the EU issues importation to the UK public as they should have been doing for decades.

Pity that leaving the EU just leaves US with those same politicians....

I would like to know just how many of this country's MP's are career MP's. How many have lived in the 'real' world where lack of money restricts our ability to do the things we want to do.

How many went to university to study politics? How many political lecturers have an agenda? How many university's imbue our future leaders with flawed logic?

The political elite (whatever that actually means) will do what is best for them and their elitist friends rather than what is in the best interests of the UK.

I feel that all discussions regarding the UK's exit should be broadcast in full. People under scrutiny know they have to deal with real matters rather than what they want

If you are asked to deal with any matter via private message, PLEASE report it.

http://www.dailymail.co.uk/news/article-2175695/One-seven-MPs-real-job.html

^^^ According to this article from 2012, only 1 in 7 have had a 'real' job

One in seven MPs have never had a proper job, according to research.

And in addition to those who have absolutely no experience of working in the real world, many more have served only brief stints as lobbyists or public relations advisers before entering politics full-time.

This one from 2015 is even more interesting.

http://www.telegraph.co.uk/news/general-election-2015/politics-blog/11498660/Revealed-how-many-General-Election-candidates-have-had-real-jobs-and-how-many-are-professional-politicians.html

According to the House of Commons Library, there has been real growth in professional politicians, people who come to the Commons from a job elsewhere in politics. Some 21 of the MPs elected in 1979 were previously employed in politics, 3.4 per cent of the total.

By 2010, there were 90 career professionals on the green benches, 15 per cent of the House. The number of professionals (lawyers, doctors, teachers) is also in slow decline, and the number of business people entering politics is more or less stable. So are we in for more of the same?

Thanks to UCL's Parliamentary Candidates UK project, we now know the answers about the potential class of 2015. Around one in four (26 per cent) of new candidates contesting the 2015 general election are political professionals currently working as advisers, researchers, party officials, trade unionists or lobbyists.

The Scottish National Party has by far and way the highest proportion of party insiders standing for Parliament (47 per cent, with Labour and Plaid Cymru following behind (33 per cent). The party with the smallest proportion of candidates from an "instrumental" (i.e. political insider) background is Ukip, at just 20 per cent, as befitting their image as the "People's Army" standing against the "establishment".

And this YouGov article

https://yougov.co.uk/news/2014/07/24/public-want-more-mps-factory-fewer-courtroom/

Going back to 1979, Nuffield election studies show no less than one in ten MPs from the three main parties have been barristers or solicitors, and the percentage of MPs that had been publishers or journalists has never fallen below 6%. Over the same period, the percentage of MPs who had occupations as manual workers – such as miners – has decreased steadily from 15.8% 35 years ago to just 4% today.

A new YouGov survey suggests voters would prefer if that trend were reversed. 57% want more factory workers elected to Parliament; 61% want more doctors (who made up only 1.4% of main-party MPs as of 2010) and 57% want more scientists.

Majorities also want more economists (54%) and teachers (52%). By contrast, a minority want more police officers (46%), social workers (44%) and military officers (41%) elected to Parliament. The public actually tend to prefer if there were fewer lawyers (46% fewer to 24% more) and reporters (48% fewer to 18% more) filling Westminster, making those the least popular occupations on the list.

Voters of different political stripes do especially like certain occupations when it comes to future MPs. The most favoured groups among Conservative voters are doctors (64% want "more") and economists (65%); among Labour voters they are doctors (71%) and factory workers (72%). Lib Dems are most likely to want more teachers (62%) and scientists (63%), while UKIP voters want more factory workers (62%).

http://www.telegraph.co.uk/news/2017/02/27/sir-john-major-warns-theresa-may-hard-brexit-could-mean-cuts/

No real trade deals to replace what we have,

The UK a Tax haven, with the rich paying nothing (definition of a tax haven)

With Employers getting the cheapest goods and Labour they can

- hence wages fall

- hence taxation income falls (especially as the rich wont be paying any)

- hence tax for the 'workers' will increase as funding for services including the NHS is ditched (unless you call 20-25% year on year reductions anything other than ditched)

The rich get LOTS richer and EVERYONE else will get LOTS poorer

That IS the future.

But dont worry - MP's pay will be safeguarded.

and before anyone squeals about has been politicians

Blair

Major

Heseltein

et al

You really dont know what you had until you've got edit as replacements do you

"The government introduced a special annual tax on homes owned via “non-natural persons” such as offshore companies in 2013, to crack down on “dirty money” used to secretly buy up luxury homes.
