I am confused here.

 

I am currently being persued for a previous HP debt which in fact I am making payments for but I dont have the car which is a different story.

 

I am concerned that one day my new car will be clamped even though it is on HP.

 

It seems that when you look at web advice...some say it is protected and some is not.

 

So...if I have a vehicle on HP:

 

Can it be clamped.

 

Can it be removed.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Is current debt subject to CCJ ?

 

What is approx amount of debt owed ?

 

I don't think an enforcement agent pursuing a different debt can clamp to take control of another vehicle that is on HP, as you don't own that vehicle until you pay the final payment due under contract.

 

I stand to be corrected by anyone quoting the legislation that applies.

We could do with some help from you.

I think you are getting confused between debt collectors [DCA's]

and BAILIFFS.

 

a DCA have no powers to do nowt!

let alone clamp a car!!

 

bailiffs [in terms of consumer debts] cant get involved until

whomever gets a CCJ and you fail to pay it.

 

 

and even then as its CCA related and under £5k? they cant get involved?
