    • This is a bit of a lengthy one but I’ll summerise best as possible.
       
      THIS IS HOW THE PHONECALL WENT 
       
      I was contacted by future comms by phone, they stated that they could beat any phone contract I have , (I am a limited company but just myself that needs a business phone and I am the only worker) 
      I told future comms my deal, £110 per month with a phone and a virtual landline, they confirmed that they could beat that, £90 per month with a phone , virtual landline  they also confirmed they would pay Vodafone (previous provider) the termination fee. As I am in business, naturally I was open to making a deal. So we proceeded. 
      Future comms then revealed that the contract would be with PLAN.COM and the airtime would be provided by 02, I instantly told them that this would break the deal as I have poor 02 signal in the house where I live as my partner is on 02 and constantly complaining about bad signal
      the salesman assured me he would send a signal booster box out with the phone so I would have perfect signal.
      so far so good.....
      i then explained this is the only mobile phone I use for business and pleasure, so therefore I didn’t want any disconnection time in the slightest between the switchover from Vodafone to 02
      the salesman then confirmed that the existing phone would only be disconnected once the new phone was switched on.
      so far so good....

    • The FSA has announced large fines against DB UK Bank Limited (trading as DB Mortgages) - DeutscheBank and also against Redstone for their unfair treatment of their customers.
      Please see the links below for summaries and full details from the FSA website.
      It is now completely clear that any arrears charges which exceed actual administrative costs are unfair and therefore unlawful.
      Furthemore, irresponsible lending practices are also unfair and unlawful.
      Additionally there are other unfair practices including unarranged counsellor visits - even if they have been attempted.
      You are entitled to refuse counsellor visits and not incur any charges.
      Any charges for counsellor visits must not seek to make profits. The cost of the visits must be passed on to you at cost price.
      We are hearing stories of people being charged for counsellor visits for which there is no evidence that they were even attempted.
      It is clear that some mortgage lenders are trying to cheat you out of your money.
      You should ascertain how much has been taken from you and claim it back. The chances of winning are better than 90%. It is highly likely that the lender will attempt to avoid court action and offer you back your money.
      However, you should ensure that you receive a proper rate of interest and this means that you should be seeking at least restitutionary damages - which would be much higher than the statutory 8%.
      Furthermore, you should assess whether the paying of demands for unlawful excessive charges has also out you further into arrears and if this has caused you further penalties in terms of extra interest or any other prejudice. This should be claimed as well.
      If excessive unlawful charges have resulted in your credit file being affected, then you should take this into account also when working out exactly what you want by way of remedy from the lender.
      You should consult others on these forums when considering any offer.
      You must not make any complaint through the Ombudsman. your time will be wasted, you will wait up to 2 yrs and there will be a minimal 8% award of interest and no account will be taken of any other damage you have suffered.
      You must make your complaint through the County Court for a rapid and effective remedy.

Robbersway for HPH2 chasing old Tesco Credit card 'debt'

IMHO I wouldn't be offering anything more than £1 a month for the life of the debt, this is by no means a priority debt and your offer should reflect that.

 

IF, you feel you need to pay Robbersway anything at all, which I certainly wouldn't.


Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

AFAIK that's all it is, a threat, either way, you won't stop someone from taking you to court, even if you started paying.

 

If you paid them £1 a month then they would look very silly trying to take you to court for a debt that you're already paying.

 

But the fact is, they have offered you a discount, so something must be amiss somewhere...??

I have no record of a default from OC and as there is no record of this account on my credit file so i short I don’t know.

sorry I couldn't review the thread

you said earlier:

then IMHO I would NOT reply nor offer payment.

 

all paying this will do is elongate the SB status

 

they have offered discounts

usually indicates something is wrong.

its defaulted and should now not be showing on your credit file so cant harm you .?

 

they have had this debt sold to H2HP for years now

so they've not done nowt to date

and most prob not do anything.

 

do you know the assignment date??

Assingment date 21/01/2016.....after this the heat got turned up, culminating in the court action threat and why I put in CCA request.

no when it was sold by the OC to xx dca. who was?

 

rway are just another name for the same DCA that bought the debt I bet

 

I suggest its was about the time of the default?

As far as I am aware this is the first time it’s been ’sold’.

 

 

In the past it has been with Wescot, Fredrickson and a couple of other DCA’s

who all stated in their letters that Tesco is the ‘client’.

 

 

I have no earlier notice of assignment.

 

 

Id does seem a bit odd that its been with Tesco for so long though.

ok no that appears to be correct then.

 

Tesco do keep hold of debts

 

wescot freddies etc are all not debt buyers but as you point

chase for 'their client'

that you say was named as Tesco.

they go for Discounts as they aren't confident they'll get a CCJ .

Hi,

 

I had been receiving regular letters regarding this alleged debt from Robinsway with the usual 'please contact us and agree a payment plan' but no futher threats of court action. It all went quiet

 

I received a letter mid July with usual might do threats of sols a then a letter 2 weeks later saying the same but in different language. They gave me 10 days to respond.

 

Today I received a letter from RW offering me a massive discount! over 50%.

I cant find anything wrong with the agreement and the debt is not SB.

 

They have said that they are prepared to accept monthly instalments.

Should I just hold tight or offer them something?

 

Will paying them anything re set the SB clock?

Hi

I received a NoA from Hoist Finance UK stating that the dept had been assigned to themselves from Hoist Portfolio Holding Limited.(are they the same company?)

 

Didn't really think anything of it

 

today I receive a ' letter of claim' from Howard Cohen saying agree a payment plan, pay up or we go to court.

They state that Robersway are still responsible for collection (who have previously offered me 55% discount).

 

So your good advice please.

This debt is SB mid next year,

should I wait and see what happens or are they serious this time?

 

I've been down this road with them before and they took no further action other than offering me a massive discount!
