    • One last query, the works have already been agreed to by ourselves as we have had no choice and should be completed today. So should this paragraph be requesting payment rather than asking from them to agree to commence works?    Also, we currently have a courtesy car provided by Mercedes which will be required back when we collect the car so I don’t think we’ll need to be requesting a courtesy car from Doves, unless they want the car back to review themselves? 
    • No HB, I dont think they are currently. Just different figureheads - and I'm not that sure about the second part. Half the Tory cabinet are hard right/poopulists and many of the Tory doners   Oh - and why are people talking about the 'extinction of the Tory party with 20% of the vote and 70-90 seats .. But the rise of the Reform party with a media driven 11% of the vote and - 4 seats being seen as an outside chance epic victory?   I'll bet if there were a kkk party in the UK it would do similarly to the reform core vote and split the hard right vote The Uk is very clanish - and consider themeselves tory or labour or whatever - although the extreme parties now do seem to be cracking that edifice somewhat - I hope

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I could really do with some advice here. I ordered £1300 worth of Israeli Shekels from Travelfx.com. Part of their service is to deliver by Royal Mail Special Delivery (1pm). I ordered for delivery on Thursday 1st September.

 

Travelfx have issued all confirmations and a tracking number, and when I got home on 1st September, I had a card saying by item had been returned to the sorting office and I could collect the next morning.

 

I went, and Royal Mail have LOST the parcel (the card I have been left means it's definitely been in their possession)!

 

They have 5 days before they have to say it's lost. Royal Mail won't reimburse me as they say I have to get it back from the Co. I bought it from (who then claim it back from Royal Mail). Travelfx state that they will not refund me until they have actually got the money back from Royal Mail, which could take up to 28 days.

 

By that time, my holiday will be long over. I will be stuck with a load of foreign currency I don't need, and in the meantime, I now have to find the money again! Royal Mail have confirmed they have passed this to their security department as it's definitely not in the sorting office. They've mooted that they've started a security investigation as this may be theft.

 

Surely due to this (at best) incompetence or (at worst) criminality, I shouldn't be so significantly out of pocket. Can anyone confirm who is liable to refund me, and how soon? S

 

I am really distraught as this has ruined a massive family reunion that we've been planning for years.

Hi and welcome to CAG

 

As I see it, Travelfx are the customer of the Royal Mail and not you.

 

You may have paid Travelfx the postage costs but it was they that have contracted with RM. You have no contract. You cannot claim.

 

Your only point of claim is with Travelfx and it should be them that is taking this on board and helping you.

 

I can't see an easy way for you out of this.

Have a chat with the local delivery office manager on the phone. Before we all start shouting theft the postman might have left it in his pouch under his frame by mistake and not returned it to the registered letter enclosure. He might be on leave and sitting in his pouch at home. It is very rare despite the publicity you have bent postal staff

I have had many many chats with the delivery office manager - my hubbie is also an ex postie so knows about all the places it could be. It is not in any bag, frame, van, cupboard or safe at that office. The postman was insistent he handed it back in, but it wasn't scanned and they have no record of booking it back in. I spoke to the Delivery Office Manager Friday morning, Friday evening, and Saturday morning. they have assured me they have searched everywhere and it is definitely not in that office. As my husband's ex colleagues I would not have been quick to think this either, but the office has been searched top to bottom, and Royal Mail have even confirmed to me that they have already passed it on for internal investigation

It's not under the drivers seat either. they've confirmed they've checked everywhere. I am not saying it's theft, but they have confirmed to me categorically that it is definitely missing. They cannot find it.

 

Thanks for the advice, but they have told me several times they have looked in all the places you are suggesting.
