    • a court bailiff will not do that and fleecing DCA's cant use HCEO as its a regulated consumer credit agreement under £5k. you'll not find one CCJ thread here where this has ever been any diff. forget google! bit like the USA election was rigged and trump won twaddle.   stick with cag eh?   so use our search top right in the red banner backdoor CCJ whilst you await getting the info.      
    • please just type no need to keep hitting quote....   read what it says in red at the top of the CPR 31:14 template..carefully again.. i can see this thread continuing with these series of schoolboy errors and you screwing up if you dont learn to read and follow things carefully .   just send the CPR as is no need to worry about if or not something is applicable . they rarely respond anyway which is why we say don't miss defence filing date whatever happens..

    • The two companies are lowell and cabot.   I'll get the information and come back with it.   I did do quite a bit of 'Google' research before coming on here. There's a lot of confusing information out there they seem to tell you half the story.   Just so I'm clear. Bailiffs in my situation, if authorised by a court. Can enter the property through an unlocked door and seizure goods? Or can they not do that with a consumer credit ccj? Or point me in the right direction so I can read up on it.   Thank you for your help. It's good to finally speak to somebody who tells you how it is.

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
       
      I opted for mediation, and it played out very similarly to other people's experiences.
       
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
       
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
       
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
       
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
       
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

I wonder if someone could help me.

 

Today I received a notice of removal from Marstons for a court fine back in 2012.

 

 

They said that the court had been trying to find me for 4 years

in Apriil sent a letter to my current address which is a total lie as I have never received anything from them.

 

This is where is gets complicated.

 

 

i moved out of London in August 2013.

I can remember them endorsing my license but I cannot remember a fine.

 

 

Also they are charging 1285.00.

I don't understand why they have charged me so much.

 

 

The bailiff explained it was because they had been looking for me for 4 years.

I have explained that this is not my fault if they are unable to find me.

Why am I being penalised for something I knew nothing of.

This is extremely excessive for something I know nothing of.

 

 

I certainly don't have that sort of money to be able to deal with this.

Also from November 2013 to June 2014 I was homeless due to a house fire

so anything that would have gone to the address would have been returned.

 

Also this is a removal notice.

I did not receive any form of enforcement notice which the bailiffs admitted most probably went to my old address!!!

So I asked them if that is the case how am I meant to know of this to which they couldn't answer.

 

Can you please advise me what my next move should be

as this is completely unfair to expect me to pay 1285 for something I knew nothing of.

I would suggest as a matter of urgency that you visit the DVLA website and check your driving licence details on there. You will need to have your driving licence with you as you will need your licence number. You should find details of any fines together with the dates and court details etc.

 

Can you post back once you have done this.

Just a short update. It has been discovered that Sonia has two court fines (and not one). After enquiries have been made with the London Collection & Compliance Centre, arrangements are in place to get a Statutory Declaration submitted.

 

Marston Holdings have placed the account on hold for a 28 day pending the Statutory Declaration hearing.
