Lowell solicitors chasing unknown CCJ - help please

Morning

hope someone here can help

I'm in right mess

so much so I have no idea who I owe money to

and who I have paid off��

 

I've buried my head in the sand for to long but now it's starting to effect my health

 

I'm going to try and tackle this situation head on

 

but think taking them on 1 at a time

not sure I could cope facing them all at once,

I also need to look into ppi claims on top.

 

However this morning

about 15 mins ago I had a letter from Lowell solicitors saying they had not received £50 payment ordered

under the terms of the ccj amount of £1550 from their client lloyds

 

I had no idea it had been to court

I honestly thought this was dealt with years ago when I dealt with another debt company

and sent them a statue barred letter as no payment was made on the debt for over 6 years.

 

Also it says the ccj amount is £1550

but on the right of the letter balance is £1924.78

 

I'm so confused and have no idea what's best to do.

check Noodle/clear score free to use see if a CCJ etc is listed on there for starters, sometimes if you move and do not tell creditors that you have moved, they sell to debt buyer who then start proceedings at your old address if no correspondence from you?

Ok thank you

 

I've registered with noodle credit score is very poor 1/5 or 455 average in my area is 612

I can't seem to see where the ccj would show

 

On my report Lloyds show in the closed account section with satisfied under it

Check Trust register..this will determine if you do have a CCJ and then you get the details and investigate further.

There is one registered on 8/1/14 for £1924 but does not say who is for

 

Sorry ignore that the claim number is the same I received on the letter this morning so yes it's lloyds

 

So where do I go from here just ring and arrange a payment plan ?

That all depends on whether you accept the CCJ or dispute it..the fact that you was unaware and never received a claim form is of concern and could be a point to set a side the judgment and defend it...but only of you have grounds to defend it..if not and you are happy to start paying the judgment..then yes contact Lowell's and arrange a payment.

 

If you are not happy with the amount set by the court and wish to try to reduce it you can submit a form to the court (N245 in the Legal Library) and submit a fresh income and expenditure and a proposed monthly figure.(there is a fee of £50 to submit this form unless you qualify for exemption due to low income)

Are you sure it says their client Lloyd's?

I expect the debt was sold on by Lloyd's and now has nowt to do with them anymore

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

You could ring LLoyds...and ask assuming you know the account/agreement number...ask when was the last payment or deposit and when was it assigned to Lowell's.

Phone call is quicker...if they have assigned it they may fob you off...but if you can get a date that will roughly work out the assignment date...but its the last payment date that is crucial to you and whether you could then set a side on statue barred basis.

Update after speaking with lloyds

 

Account was closed and default was registered in 2009 and sold to robinsonway debt collect

 

They sold it on to Lowell on 22/7/2013

 

Last payment was made to the account via Robinson way on 21/6/11 for £33.00

when they bought the debt in 2013

theres no rush

there not a lot they can do to you.

 

what puzzles is some of your answers...

 

Lowell would not have had Lloyds as their client [something wrong here]

 

robbersway and lowells are 2 totally different DCA's

 

so I would guess that you were paying Lloyds thru robbersway on the debt

before they sold it to lowells.

 

I'd be checking if that £33 in 2011 was the only payment or if there was a few before that.

 

do you know when you opened the account and what was it

loan, overdraft, credit card?

 

get your ducks inline first

before you start to cough up

 

sar time to Lloyds.

Hiya thanks again so far for all the help after speaking to lloyds they informed me I paid Robinson way £33 a month for about 6 months with the last payment as above

 

In regards to the client my apologise it's says out client Lowell portfolio ltd and original client lloyds

It was a bank account with a monthly subscription fee for extra insurances

 

Also Lowell filed a ccj back in 2014 so I assume they can take further action for non payment of a ccj
